AN ACT

Amending Title 71 (State Government) of the Pennsylvania

2

Consolidated Statutes, further providing for mandatory and

3

optional membership.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5301(a)(2) of Title 71 of the

7

Pennsylvania Consolidated Statutes is amended to read:

8

§ 5301.  Mandatory and optional membership.

9

(a)  Mandatory membership.--Membership in the system shall be

10

mandatory as of the effective date of employment for all State

11

employees except the following:

(2)  [Lieutenant Governor.]

Section 2.  Upon the ratification of the amendment to the

16

Constitution of Pennsylvania abolishing the office of Lieutenant

17

Governor, the Secretary of the Commonwealth shall cause the date

18

of ratification to be published in the Pennsylvania Bulletin.

Section 3.  This act shall take effect as follows:

(1)  Section 2 of this act and this section shall take

3

effect immediately.

4

(2)  Section 1 of this act shall take effect upon

5

publication in the Pennsylvania Bulletin of the ratification

6

date of the amendment to the Constitution of Pennsylvania

7

that abolishes the office of Lieutenant Governor.
