AN ACT

Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An

2

act to consolidate, editorially revise, and codify the public

3

welfare laws of the Commonwealth," in public assistance,

4

further providing for definitions; repealing provisions

5

relating to general assistance-related categorically needy

6

and medically needy only medical assistance programs; and

7

establishing the General Assistance Program.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

10

Section 1.  The definition of "general assistance-related

11

categorically needy medical assistance" in section 402 of the

12

act of June 13, 1967 (P.L.31, No.21), known as the Public

13

Welfare Code, added June 30, 2012 (P.L.668, No.80), is amended

14

and the section is amended by adding a definition to read:

15

Section 402.  Definitions.--As used in this article, unless

16

the context clearly indicates otherwise:

17

"General assistance" means assistance for individuals who

19

meet the requirements under section 432(3).

["General assistance-related categorically needy medical

assistance" means medical assistance for persons who meet the

requirements under section 432(3).]

Section 2.  Section 403.2 of the act, added June 30, 2012

5

(P.L.668, No.80), is repealed:

6

[Section 403.2.  General Assistance-Related Categorically

7

Needy and Medically Needy Only Medical Assistance Programs.--(a)

8

Subject to subsection (b) and notwithstanding any other

9

provision of law, the general assistance cash assistance program

10

shall cease August 1, 2012.

11

(b)  The general assistance-related categorically needy

12

medical assistance program shall continue, including, but not

13

limited to, the eligibility and work and work-related

14

requirements under this article. The general assistance-related

15

medical assistance program for the medically needy only shall

16

continue.]

Section 3.  The act is amended by adding a section to read:

18

Section 403.3.  Establishment of General Assistance

19

Program.--(a)  The General Assistance Program is established

20

within the department. The program shall be designed to help

21

residents of this Commonwealth who do not meet the Federal

22

requirements of Temporary Assistance for Needy Families program

23

by providing them with cash assistance grants and medical

24

assistance benefits.

25

(b)  Eligible recipients of general assistance shall include:

26

(1)  Childless adults with a permanent or temporary

27

disability.

28

(2)  Domestic violence victims.

29

(3)  Children under eighteen years of age under the care of

30

an unrelated adult.

(4)  Individuals between eighteen and twenty years of age

2

attending a secondary school.

(5)  Individuals in a drug and alcohol treatment program.

4

(6)  Any additional individuals that the department may deem

5

appropriate.

(c)  Cash grants shall be paid to an eligible recipient

7

either biweekly or monthly, at the discretion of the department

8

and depending on the circumstances of the eligible recipient.

9

Recipients shall meet the work requirements outlined in section

10

432.3 in order to be eligible for both the cash grant and

11

medical assistance benefits of the General Assistance Program.

12

(d)  Eligibility for the General Assistance Program shall be

13

redetermined at least once a year to ensure that each recipient

14

receiving benefits under the program continues to be eligible

15

for the benefits.

16

(e)  The sum of one hundred thirty million dollars

17

($130,000,000) shall be transferred annually from the State

18

Gaming Fund to the department for the purpose of issuing cash

19

grants through the department's General Assistance Program.

20

Section 4.  This act shall take effect immediately.
