AN ACT

Providing for the use of certain historical writings, documents

2

and records in public schools and during public school

3

events; and prohibiting censorship based on religious or

4

other references in certain historical writings, documents

5

and records.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Use of historical writings, documents and records

9

with religious references in public schools.

10

(a)  Writings enumerated.--In conformance with provisions of

11

22 Pa. Code Ch. 4 (relating to academic standards and

12

assessment), local school boards may allow and encourage any

13

teacher or administrator in a public school district of this

14

Commonwealth to read or post in a public school building or

15

classroom or during any school-sponsored or school-related

16

event, any excerpts or portions of the following:

17

(1)  The Preamble to the Constitution of Pennsylvania.

18

(2)  The Declaration of Independence.

(3)  The Constitution of the United States.

2

(4)  The Mayflower Compact.

3

(5)  The national motto.

4

(6)  The National Anthem.

5

(7)  The Pledge of Allegiance.

(8)  The writings, speeches, documents and proclamations

7

of the founding fathers and presidents of the United States.

8

(9)  Organic documents from the pre-Colonial, Colonial,

9

Revolutionary, Federalist and post-Federalist eras.

10

(10)  United States Supreme Court decisions.

11

(11)  Acts of the United States Congress, including the

12

published text of the Congressional Record.

13

(b)  No censorship.--There shall be no content-based

14

censorship of American history or heritage in this Commonwealth

15

based on religious or other references in these writings,

16

documents and records.

Section 2.  District notification.

18

Upon enactment, a copy of this act shall be distributed

19

immediately to each board of school directors in this

20

Commonwealth by the Department of Education.

21

Section 3.  Effective date.

22

This act shall take effect in 60 days.
