AN ACT

Providing for the public display of the foundation of American

2

law and government.

3

The General Assembly finds and declares as follows:

4

(1)  There is a need to educate and inform the public

5

about the history and background of American law.

6

(2)  State and local government buildings in this

7

Commonwealth are an ideal forum in which to display

8

educational and informational material about the history and

9

background of American law.

10

(3)  A basic knowledge of American constitutional history

11

is important to the formation of civic virtue in our society.

12

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Short title.

15

This act shall be known and may be cited as the Foundations

16

of American Law and Government Display Act.

Section 2.  Definitions.

The following words and phrases when used in this act shall

2

have the meanings given to them in this section unless the

3

context clearly indicates otherwise:

4

"Foundations of American law and government."  All of the

5

following materials:

6

(1)  The Mayflower Compact from 1620.

7

(2)  The Ten Commandments as extracted from Chapter 20 of

8

the Book of Exodus in the Bible.

9

(3)  The Declaration of Independence.

10

(4)  The Magna Carta.

11

(5)  "The Star-Spangled Banner" by Francis Scott Key.

12

(6)  The national motto.

13

(7)  The Preamble to the Constitution of Pennsylvania and

14

the Declaration of Rights contained in Article I.

15

(8)  The Bill of Rights of the Constitution of United

16

States.

17

(9)  A description of the iconic symbol commonly referred

18

to as Lady Justice.

19

Section 3.  Foundations of American law and government display.

20

(a)  General rule.--The Commonwealth and each municipality or

21

political subdivision may display the foundations of American

22

law and government in a visible, public location in any public

23

building, property or courthouse.

24

(b)  Context to be provided.--

25

(1)  A public display of the foundations of American law

26

and government as authorized by this act shall include a

27

context for acknowledging the formative and historical

28

significance of the materials to the heritage of the United

29

States.

(2)  The Commonwealth, municipalities and political

subdivisions may consult with the Pennsylvania Historical and

2

Museum Commission on the development of the context required

3

under this subsection.

(c)  Specifications.--Each of the materials of the

5

foundations of American law and government that are displayed in

6

accordance with this act shall be presented on pages not less

7

than 11 by 14 inches in dimension and shall be framed in

8

identical styled frames. No one material of the foundations of

9

American law and government may be displayed more prominently

10

than another and no one material may be excluded from the

11

display.

(d)  Funding.--

13

(1)  Except for consultation with the Pennsylvania

14

Historical and Museum Commission, no State funds or public

15

money of a municipality or political subdivision may be used

16

for a display of the foundations of American law and

17

government in accordance with this act.

18

(2)  Notwithstanding paragraph (1), the Commonwealth and

19

each municipality or political subdivision may solicit and

20

accept donations of private funds for the cost of

21

constructing and displaying the foundations of American law

22

and government in accordance with this act.

23

Section 4.  Effective date.

24

This act shall take effect in 60 days.
