AN ACT

Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An

2

act to consolidate, editorially revise, and codify the public

3

welfare laws of the Commonwealth," in departmental powers and

4

duties as to licensing, further providing for definitions and

5

for regulations.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Section 1001 of the act of June 13, 1967 (P.L.31,

9

No.21), known as the Public Welfare Code, is amended by adding

10

definitions to read:

Section 1001.  Definitions.--As used in this article--

12

"Child development student" means a student of a Pennsylvania

14

vocational-technical school who is:

15

(1)  at least thirteen years of age; and

16

(2)  enrolled in an early childhood education program and

17

under the supervision of a program instructor or a child-care

18

staff member.

"Early childhood education program" means a course of study,

2

approved by the Department of Education, at a Pennsylvania

3

vocational-technical school that is intended to prepare students

4

for careers or postsecondary education in child care or early

5

childhood education.

Section 2.  Section 1021 of the act is amended by adding a

8

subsection to read:

Section 1021.  Regulations.--* * *

10

(e)  Within one hundred eighty days of the effective date of

11

this subsection, the department shall adopt regulations that

12

allow child development students to serve as volunteers in child

13

day care centers. The following apply:

14

(1)  a child development student volunteering in a child day

15

care center must be supervised by a program instructor or a

16

child-care staff member at all times;

17

(2)  a child development student must be at least five years

18

older than any child receiving care at the child day care center

19

where they are serving as a volunteer;

20

(3)  serving as a volunteer in a child day care center must

21

be a requirement of the early childhood education program in

22

which the child development student is enrolled; and

23

(4)  a child development student serving as a volunteer in a

24

child day care center may not receive remuneration for his

25

service.

Section 3.  This act shall take effect in 60 days.
