AN ACT

Amending Title 34 (Game) of the Pennsylvania Consolidated

Statutes, providing that hunting and trapping are property

3

rights.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 103 of Title 34 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 103.  Ownership, jurisdiction [and], control of game and

9

wildlife and property rights.

(a)  General rule.--The ownership, jurisdiction over and

11

control of game or wildlife is vested in the commission as an

12

independent agency of the Commonwealth in its sovereign capacity

13

to be controlled, regulated and disposed of in accordance with

14

this title.

15

(b)  Method of management.--The commission shall utilize

16

hunting and trapping as methods of effecting necessary

17

management of game, furbearer and wildlife populations.

18

(c)  Property rights.--Hunting and trapping are property

19

rights which cannot be taken away without the benefit of due

process of law.

Section 2.  This act shall take effect in 60 days.
