AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," prohibiting wireless telephone use by

6

school bus drivers.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  The act of March 10, 1949 (P.L.30, No.14), known

10

as the Public School Code of 1949, is amended by adding a

11

section to read:

Section 1361.1.  Use of Wireless Telephones Prohibited.--(a)

13

The use of cellular or other wireless telephones by school bus

14

drivers while operating a school bus is prohibited.

15

(b)  The prohibition contained in subsection (a) shall not

16

apply when the school bus is parked in a safe area off of a

17

trafficway as defined in 75 Pa.C.S. § 102 (relating to

18

definitions) or in an emergency situation.

19

Section 2.  This act shall take effect in 60 days.
