AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for election of

6

school directors.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Section 301 of the act of March 10, 1949 (P.L.30,

10

No.14), known as the Public School Code of 1949, is amended to

11

read:

Section 301.  Board of Directors; Election or Appointment.--

13

(a)  The public school system of the Commonwealth shall be

14

administered by a board of school directors, to be elected or

15

appointed, as hereinafter provided. At each election of school

16

directors, each qualified voter shall be entitled to cast one

17

vote for each school director to be elected. Any system

18

providing for cumulative voting for the office of school

19

director is hereby abolished.

(b)  Except as provided in subsection (c), school directors

shall be elected in accordance with the act of June 3, 1937

2

(P.L.1333, No.320), known as the "Pennsylvania Election Code."

3

(c)  A primary election for school director nominations shall

4

not be held for the 2013 municipal elections and thereafter.

5

School directors shall be elected at the November municipal

6

election beginning in 2013.

7

(d)  Notwithstanding section 951 of the "Pennsylvania

8

Election Code," nomination papers for the office of school

9

director shall be filed in the same manner as nominations of

10

candidates by political bodies or independent candidates, as

11

provided by the "Pennsylvania Election Code," without regard to

12

political party membership. A circulator of a nomination paper

13

must reside in the same school district referred to in the

14

nomination paper and be registered as a member of a political

15

party or as nonaffiliated with a political party. Nomination

16

papers for the office of school director must include the

17

signatures of a minimum number of qualified electors, without

18

regard to political party affiliation as follows:

19

(1)  two hundred fifty for a school district of the first

20

class;

21

(2)  two hundred for a school district of the first class A;

22

(3)  one hundred for a school district of the second class;

23

(4)  fifty for a school district of the third class; and

24

(5)  twenty-five for a school district of the fourth class.

25

(e)  A candidate's political party affiliation shall be

26

printed on the ballot for election.

Section 2.  Section 302.1(d) of the act, added December 19,

28

1975 (P.L.511, No.150), is amended to read:

act of June 3, 1937 (P.L.1333, No.320), known as the

"Pennsylvania Election Code."]

Section 3.  All acts and parts of acts are repealed insofar

9

as they are inconsistent with this act.

Section 4.  This act shall take effect as follows:

11

(1)  The amendment of section 301 of the act shall take

12

effect December 31, 2012.

13

(2)  The remainder of this act shall take effect in 60

14

days.
