AN ACT

Permitting supervised children to observe polling places.

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

4

Section 1.  Short title.

5

This act shall be known and may be cited as the Voting

6

Observation for Children Act.

7

Section 2.  Definitions.

The following words and phrases when used in this act shall

9

have the meanings given to them in this section unless the

10

context clearly indicates otherwise:

11

"Election."  As defined in section 102 of the act of June 3,

12

1937 (P.L.1333, No.320), known as the Pennsylvania Election

13

Code.

14

"Election day."  A day on which an election is held.

15

"Election district."  As defined in section 102 of the act of

16

June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania

17

Election Code.

"Judge of elections."  An individual elected or appointed to

2

serve as a judge of elections under Article IV of the act of

3

June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania

4

Election Code.

"Polling place."  As defined in section 102 of the act of

6

June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania

7

Election Code.

Section 2 3.  Observation.

(a)  Authorization.--Notwithstanding any other provision of

10

the act of June 3, 1937 (P.L.1333, No.320), known as the

11

Pennsylvania Election Code, a local judge of elections may

permit a group of supervised, school-aged children to observe a 

<--

13

the polling place that he or she oversees on election day.

(b)  Conditions.--The following conditions apply:

15

(1)  The group must be observing the polling place as

16

part of a school curriculum.

17

(2)  The teacher or group leader must provide advance

<--

18

notice to the local judge of elections for approval of the

19

observation other school employee who will serve as the group

<--

20

leader during the observation must submit a request to the

21

applicable judge of elections to observe a polling place no

22

later than ten days prior to the election.

23

(3)  No observation of a polling place under this act

24

shall occur unless the applicable judge of elections has

25

given written authorization for the observation.

26

(c)  Time and size.--

27

(1)  The observation shall occur at an off-peak or other

28

time that will ensure as little disruption in voting to the

29

public as possible, as determined by the judge of elections.

(2)  The local judge of election shall limit the size of

the observing group and the group's supervisors, including

the group's leader, as needed based on the size of the

3

polling location place.

Section 10 4.  Effective date.

This act shall take effect in 60 days.
