| AN ACT |
| |
1 | Establishing an economic forum for the forecasting of State |
2 | revenue; and providing for its powers and duties. |
3 | The General Assembly finds and declares that: |
4 | (1) The Commonwealth has consistent problems obtaining |
5 | the most accurate possible forecasts of its economic future, |
6 | including State revenues and spending. |
7 | (2) Poor budgetary projections lead to large fiscal |
8 | imbalances and may turn what might have been a manageable |
9 | problem, had it been handled in time, into a crisis. |
10 | (3) The State revenue forecasting process is fraught |
11 | with opportunities for political gamesmanship. |
12 | (4) A process is needed to produce accurate, timely |
13 | estimates of future State revenues and to enlist in that |
14 | process economic and taxation experts of known ability. |
15 | The General Assembly of the Commonwealth of Pennsylvania |
16 | hereby enacts as follows: |
17 | Section 1. Short title. |
18 | This act shall be known and may be cited as the Forecasting |

1 | of State Revenue Act. |
2 | Section 2. Definitions. |
3 | The following words and phrases when used in this act shall |
4 | have the meanings given to them in this section unless the |
5 | context clearly indicates otherwise: |
6 | "Economic forum." The economic forum established by this |
7 | act. |
8 | "State employee." The term does not include an employee of a |
9 | publicly funded institution of higher education. |
10 | Section 3. Economic forum. |
11 | (a) Establishment.-- |
12 | (1) An economic forum is established for the State |
13 | government which shall be composed of such persons and shall |
14 | function as provided in this act. |
15 | (2) No later than three months before the convening of |
16 | each regular session of the General Assembly, the Governor |
17 | shall convene an economic forum of the persons appointed |
18 | under this section. |
19 | (b) Composition.--Each of the following persons shall |
20 | appoint one member to the economic forum: |
21 | (1) The Governor. |
22 | (2) The President pro tempore of the Senate. |
23 | (3) The Speaker of the House of Representatives. |
24 | (4) The Minority Leader of the Senate. |
25 | (5) The Minority Leader of the House of Representatives. |
26 | (c) Qualifications.--Each person appointed to the economic |
27 | forum must be an expert of demonstrated ability in economic |
28 | forecasting, with an academic or professional background in |
29 | economics, must not have a vested interest in particular |
30 | programs and must not be a State employee. |

1 | (d) Appointments.-- |
2 | (1) In the notification to each appointee of the |
3 | selection to membership on the economic forum, the appointing |
4 | authority shall inform the person that it is expected that |
5 | the deliberations of the economic forum shall represent the |
6 | best professional judgment of the members and that the |
7 | attempt by any person who is not a member of the economic |
8 | forum to influence the decisions of the economic forum shall |
9 | be promptly reported to the appointing authorities. |
10 | (2) The Governor shall notify each appointee prior to |
11 | the time that the economic forum is convened the type of |
12 | economic information to be forecast and the date by which the |
13 | forecast is desired. The economic information shall extend to |
14 | a time period as least as far in the future as any budgetary |
15 | matters to be considered by the ensuing regular session of |
16 | the General Assembly. |
17 | (e) Chairperson.--The members of the economic forum shall |
18 | select a chairperson from among their membership. |
19 | Section 4. Technical committee. |
20 | (a) Composition.-- |
21 | (1) Each person entitled to appoint a member of the |
22 | economic forum shall also appoint a member of a technical |
23 | committee. Appointees to the technical committee must be |
24 | experts of demonstrated ability in economics with an academic |
25 | or professional background in economics and have no vested |
26 | interest in particular programs. Members of the technical |
27 | committee may be State employees. |
28 | (2) The technical committee shall select a chairperson |
29 | from among its members. |
30 | (b) Duties.--The technical committee shall: |

1 | (1) Recommend to the Governor the economic variables to |
2 | be forecast and the date by which the forecast is desired. |
3 | (2) Arrive at a consensus for the methodology to be used |
4 | to prepare the State revenue forecast based upon the economic |
5 | forecast prepared by the economic forum. The technical |
6 | committee may request information, data processing support |
7 | and other assistance from State agencies. State agencies |
8 | shall comply with reasonable requests made by the technical |
9 | committee. |
10 | (c) Limited communications.--No member of the technical |
11 | committee shall communicate either verbally or in writing with |
12 | any member of the economic forum on any matter pertinent to the |
13 | economic forecast during its preparation by the economic forum. |
14 | Communications pertinent to procedural matters are permitted. |
15 | Section 5. Presentation of economic forecast. |
16 | (a) General rule.--No less than three weeks prior to the |
17 | beginning of a regular session of the General Assembly, the |
18 | individuals who have appointed members to the economic forum and |
19 | the technical committee, or their designees, shall meet in a |
20 | public meeting to receive reports from those bodies. |
21 | (b) Methodology to be delivered.-- |
22 | (1) No less than 24 hours prior to the public meeting |
23 | required in subsection (a), the technical committee shall |
24 | deliver to persons designated to attend the meeting a copy of |
25 | the methodology agreed upon by the technical committee. |
26 | (2) Subsequent to the delivery of the methodology, but |
27 | not less than 12 hours prior to the time of the convening of |
28 | the meeting, the chairperson of the economic forum shall |
29 | deliver to the chairperson of the technical committee a copy |
30 | of the economic forecast agreed upon by the economic forum. |

1 | The technical committee shall prepare a State revenue |
2 | forecast using this economic forecast and this methodology. |
3 | (c) Agenda.--The agenda for the meeting shall consist of a |
4 | discussion by the chairperson of the economic forum of the |
5 | economic forecast followed by a discussion by the chairperson of |
6 | the technical committee of the methodology. The chairperson of |
7 | the technical committee shall then present the State revenue |
8 | forecast. |
9 | (d) Duty of State agencies to use economic forecast.--All |
10 | State agencies shall use this forecast, or any component |
11 | thereof, as appropriate, in any budget or other calculations |
12 | requiring a projection of future State revenues. |
13 | Section 6. Effective date. |
14 | This act shall take effect in 60 days. |
