| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in State System of Higher Education, |
6 | further providing for project contracts. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 2003-A.1(a) of the act of March 10, 1949 |
10 | (P.L.30, No.14), known as the Public School Code of 1949, |
11 | amended July 11, 1990 (P.L.424, No.103), is amended and the |
12 | section is amended by adding a subsection to read: |
13 | Section 2003-A.1. Project Contracts.--(a) [The] Subject to |
14 | the provisions of subsection (g), the State System of Higher |
15 | Education is hereby authorized to execute and administer |
16 | contracts for construction, repair, renovation and maintenance |
17 | projects within the meaning of section 2401.1 of the act of |
18 | April 9, 1929 (P.L.177, No.175), known as "The Administrative |
19 | Code of 1929," including all aspects of project management, |
20 | design and construction and legal and administrative services |

1 | related to and necessary for the completion of such projects, |
2 | except capital projects which are funded by Commonwealth general |
3 | obligation bonds, capital appropriations or pursuant to Article |
4 | XVI-B of the act of April 9, 1929 (P.L.343, No.176), known as |
5 | "The Fiscal Code," unless delegated by the Department of General |
6 | Services to the system. |

8 | (g) Beginning on the effective date of this subsection |
9 | through June 30, 2014, the State System of Higher Education may |
10 | not execute or administer any contract for construction, repair, |
11 | renovation and maintenance projects, unless: |
12 | (1) the contract was entered into prior to the effective |
13 | date of this subsection; or |
14 | (2) the system submits a written request for an exception to |
15 | the Department of General Services and the department |
16 | determines, in writing, that an emergency exists and failure to |
17 | execute or administer the contract would be detrimental to the |
18 | health or safety of the students served by the system, the |
19 | employes of the system or the public. |
20 | Section 2. This act shall take effect in 60 days. |
