AN ACT

Amending Title 34 (Game) of the Pennsylvania Consolidated

2

Statutes, further providing for the definition of "safety

3

zone."

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 2505(c) of Title 34 of the Pennsylvania

7

Consolidated Statutes, amended July 9, 2008 (P.L.920, No.65), is

8

amended to read:

9

§ 2505.  Safety zones.

10

(c)  Definition.--As used in this section, the term "safety

12

zone" means:

13

(1)  Except as otherwise provided in [paragraph (2)] 

14

paragraphs (2) and (3), the area within 150 yards around and

15

that area which is below the highest point of any occupied

16

dwelling house, residence, or other building or camp occupied

17

by human beings, or any barn, stable, or other building used

18

in connection therewith or any attached or detached

playground of any school, nursery school or day-care center.

(2)  When applied to properly licensed persons hunting

3

with bow and arrow or crossbow and persons properly licensed

4

for falconry, the area within 50 yards around and that area

5

which is below the highest point of any occupied dwelling

6

house, residence or other building or camp occupied by human

7

beings or any barn, stable or other building used in

8

connection therewith and the area within 150 yards around and

9

that area which is below the highest point of any attached or

10

detached playground of any school, nursery school or day-care

11

center.

(3)  When applied to properly licensed furtakers trapping

13

within a permanent watercourse and using traps submerged in

14

water, or making use of any special permit issued in

15

accordance with this title or commission regulations, the

16

area within 50 yards around any occupied dwelling house,

17

residence or other building or camp occupied by human beings,

18

or any barn, stable or other building used in connection

19

therewith and the area within 150 yards around any attached

20

or detached playground of any school, nursery school or day-

21

care center.

Section 2.  This act shall take effect in 60 days.
