| AN ACT |
| |
1 | Providing for certification of central supply technicians who |
2 | perform sterilization procedures in health care facilities; |
3 | imposing continuing education requirements; and providing for |
4 | the duties of health care facilities and the Department of |
5 | Health. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Short title. |
9 | This act shall be known and may be cited as the Central |
10 | Supply Technician Certification Act. |
11 | Section 2. Definitions. |
12 | The following words and phrases when used in this act shall |
13 | have the meanings given to them in this section unless the |
14 | context clearly indicates otherwise: |
15 | "Central supply technician." A person who provides the |
16 | services of decontamination, preparation, packaging, |
17 | sterilization and storage and distribution of reusable medical |
18 | instrumentation or devices in a health care facility. |

1 | "Department." The Department of Health of the Commonwealth. |
2 | "Health care facility." As defined in section 103 of the act |
3 | of July 19, 1979 (P.L.130, No.48), known as the Health Care |
4 | Facilities Act. |
5 | "Health care practitioner." As defined in section 103 of the |
6 | act of July 19, 1979 (P.L.130, No.48), known as the Health Care |
7 | Facilities Act. |
8 | Section 3. Certification required. |
9 | No person may function as a central supply technician and no |
10 | health care facility may employ or otherwise contract for the |
11 | services of a central supply technician, unless the person meets |
12 | one of the following: |
13 | (1) holds and maintains the Certified Registered Central |
14 | Service Technician credential administered by the |
15 | International Association of Healthcare Central Service |
16 | Material Management or the Certified Sterile Processing and |
17 | Distribution Technician credential administered by the |
18 | Certification Board for Sterile Processing and Distribution, |
19 | Inc.; |
20 | (2) provides evidence that the person was employed or |
21 | otherwise contracted for the services as a central service |
22 | technician in a health care facility on or within the two- |
23 | year period immediately prior to the effective date of this |
24 | section, which evidence may include written confirmation by |
25 | the contractor or employer of the employment; or |
26 | (3) is a student or intern performing the functions of a |
27 | central supply technician if the student or intern is under |
28 | the direct supervision of an appropriately licensed or |
29 | certified health care practitioner and is functioning within |
30 | the scope of the student's or intern's training. |

1 | Section 4. Continuing employment and education. |
2 | (a) New employees.--A person may be employed or contracted |
3 | to practice as a central supply technician during the 12-month |
4 | period immediately following successful completion of |
5 | certification by the International Association of Healthcare |
6 | Central Service Material Management or the Certification Board |
7 | for Sterile Processing and Distribution, Inc., but may not |
8 | continue to be employed or under such contract beyond that |
9 | period without documentation that the employee or contractor |
10 | holds and maintains the certification required under section |
11 | 3(1). |
12 | (b) Existing employees.-- |
13 | (1) A person who is employed or contracted to practice |
14 | as a central supply technician on the effective date of this |
15 | section must be certified within two years of the effective |
16 | date of this section. |
17 | (2) A person who is employed or contracted to practice |
18 | as a central supply technician on the effective date of this |
19 | section and fails to obtain certification within the two-year |
20 | period specified in paragraph (1) may not continue to be |
21 | employed beyond that period without documentation that the |
22 | employee is certified in accordance with this act. |
23 | (c) Continuing education.--A person who qualifies to |
24 | function as a central supply technician in a health care |
25 | facility under section 3(1) and (2) shall annually complete 12 |
26 | hours of continuing education to maintain the person's |
27 | certification as a central sterile supply technician. |
28 | (d) Health care facility responsibility.--A health care |
29 | facility that employs or contracts with a central supply |
30 | technician shall verify to the department and maintain |

1 | documentation that the person is properly certified and meets |
2 | the continuing education requirements of this section. |
3 | Section 5. Other licensed practitioners. |
4 | Nothing in this act shall be construed to prohibit a licensed |
5 | health care practitioner from performing the tasks or functions |
6 | of a central supply technician if the person is acting within |
7 | the scope of the person's license as a health care practitioner. |
8 | Section 6. Departmental duties. |
9 | The department shall administer the provisions of this act |
10 | and promulgate and adopt such regulations as may be necessary to |
11 | implement this act. |
12 | Section 7. Effective date. |
13 | This act shall take effect January 1, 2013. |
