| AN ACT |
| |
1 | Establishing the Watershed Disaster Reconstruction Account; | <-- |
2 | providing for transfer from the Surface Mining Conservation |
3 | and Reclamation Fund; and making appropriations. |
4 | Providing for watershed disaster reconstruction. | <-- |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Short title. | <-- |
8 | This act shall be known and may be cited as the Watershed |
9 | Disaster Reconstruction Act of 2012. |
10 | Section 2. Definitions. |
11 | The following words and phrases when used in this act shall |
12 | have the meanings given to them in this section unless the |
13 | context clearly indicates otherwise: |
14 | "Account." The Watershed Disaster Reconstruction Account |
15 | established in section 3. |
16 | Section 3. Account. |
17 | There is hereby established within the General Fund an |

1 | account to be known as the Watershed Disaster Reconstruction |
2 | Account. |
3 | Section 4. Transfer. |
4 | The sum of $4,400,000 is hereby transferred from the Surface |
5 | Mining Conservation and Reclamation Fund to the Watershed |
6 | Disaster Reconstruction Account. |
7 | Section 5. Appropriations. |
8 | (a) Clean streams.--The sum of $3,400,000 is hereby |
9 | appropriated from the account for allocation by the Governor for |
10 | payment of the Commonwealth's share necessary to secure Federal |
11 | funding from the United States Department of Agriculture Natural |
12 | Resources Conservation Service for stream restoration. |
13 | (b) United States Army Corps of Engineers.--The sum of |
14 | $1,000,000 is hereby appropriated from the account for |
15 | allocation by the Governor for payment of the Commonwealth's |
16 | share necessary to secure Federal funding from the United States |
17 | Army Corps of Engineers to assist with small stream threats to |
18 | life and property. |
19 | Section 6. Termination. |
20 | This act shall terminate September 30, 2012, and any money |
21 | remaining in the account shall be transferred to the Surface |
22 | Mining Conservation and Reclamation Fund. |
23 | Section 7. Effective date. |
24 | This act shall take effect immediately. |

28 | Section 2. Allocations. |
29 | In accordance with section 1508(a) of the act of April 9, |
30 | 1929 (P.L.343, No.176), known as The Fiscal Code, the sum of |

1 | $1,300,000 is hereby allocated to the Governor for payment of |
2 | the Commonwealth's share necessary to secure Federal funding |
3 | from the United States Department of Agriculture Natural |
4 | Resources Conservation Service for stream restoration. |
5 | Section 10. Effective date. |
6 | This act shall take effect immediately. |
