| AN ACT |
| |
1 | Amending Title 62 (Procurement) of the Pennsylvania Consolidated |
2 | Statutes, in small and disadvantaged businesses, providing |
3 | for mentor-protégé program. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 62 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 2109. Mentor-protégé program. |
9 | (a) General rule.--Commonwealth agencies shall adopt and | <-- |
10 | institute, with the department's assistance, a mentor-protégé |
11 | program to assist, support and enable small businesses to |
12 | successfully compete for prime and subcontract awards by |
13 | partnering with large companies, which shall serve as mentors, |
14 | in State contracts. |
15 | (b) Factor to be considered.--The mentor-protégé arrangement |
16 | between a prime contractor and a minority-owned, women-owned or |
17 | disadvantaged subcontractor shall be an important factor to be |

1 | considered or weighed by the Commonwealth agency in awarding a |
2 | contract. |
3 | (c) Guidelines.--The department shall establish the |
4 | appropriate and applicable guidelines and criteria for firms to |
5 | participate in a mentor-protégé program. |
6 | (a) Establishment and purpose of program.-- | <-- |
7 | (1) The department shall establish a mentor-protégé |
8 | program to assist disadvantaged businesses in enhancing their |
9 | capabilities to compete for and perform prime contracts and |
10 | subcontracts awarded by a Commonwealth agency. |
11 | (2) The purpose of the mentor-protegé program is to |
12 | foster long-term business relationships between disadvantaged |
13 | businesses and prime contractors in order to facilitate their |
14 | growth and development and increase their prime contracting |
15 | and subcontracting opportunities with Commonwealth agencies. |
16 | (b) General rule.--A prime contractor that is approved as a |
17 | mentor by the department may enter into a written agreement with |
18 | a disadvantaged business to provide developmental assistance to |
19 | enhance the disadvantaged business contracting and |
20 | subcontracting capabilities. Developmental assistance provided |
21 | by a mentor prime contractor to its protégé disadvantaged |
22 | business may include, but not be limited to, the following: |
23 | (1) Management assistance, including financial |
24 | management, organizational management, business management |
25 | and planning and business development. |
26 | (2) Technical assistance. |
27 | (3) Financial assistance. |
28 | (4) Temporary employee assistance. |
29 | (5) Use of facilities, equipment or property without |
30 | charge. |

1 | (6) Any other type of developmental assistance as |
2 | approved by the department. |
3 | (c) Factor to be considered.--Notwithstanding any other |
4 | provision of this title to the contrary, the mentor-protégé |
5 | arrangement between a prime contractor and a disadvantaged |
6 | business whereby the disadvantaged business serves as a joint |
7 | venture partner or subcontractor to the prime contractor shall |
8 | be an important factor to be considered or weighed by a |
9 | Commonwealth agency in awarding a contract under sections 513 |
10 | (relating to competitive sealed proposals), 517 (relating to |
11 | multiple awards), 518 (relating to competitive selection |
12 | procedures for certain services) and 519 (relating to selection |
13 | procedure for insurance and notary bonds). |
14 | (d) Guidelines.--The department shall adopt and publish |
15 | guidelines to enforce and carry out the requirements of this |
16 | section. The guidelines shall be published in the Pennsylvania |
17 | Bulletin and shall include, but may not be limited to, the |
18 | following: |
19 | (1) Selection criteria for mentor and protégé |
20 | businesses. |
21 | (2) An application process, including an application |
22 | form to be used by prime contractors seeking to participate |
23 | in the mentor-protégé program and a time frame for review. |
24 | (3) Criteria for measuring program impact and success. |
25 | (4) The required contents of a mentor-protégé written |
26 | agreement. Each such written agreement shall specify the type |
27 | of developmental assistance that will be provided by the |
28 | mentor to the protégé disadvantaged business. |
29 | Section 2. This act shall take effect immediately. |
