AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

3

validity of agreement to arbitrate.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 7303 of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended to read:

§ 7303.  Validity of agreement to arbitrate.

A written agreement to subject any existing controversy to

10

arbitration or a provision in a written agreement to submit to

11

arbitration any controversy thereafter arising between the

12

parties is valid, enforceable and irrevocable, save upon such

13

grounds as exist at law or in equity relating to the validity,

14

enforceability or revocation of any contract. No binding

15

alternative dispute resolution shall be enforceable against a

16

patient of a licensed professional or other health care entity

17

that was entered into prior to the harm forming the basis of a

18

civil action in which a professional liability claim is asserted

against a licensed professional.

Section 2.  This act shall take effect in 60 days.
