AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, in rules of the road in general, further providing

3

for maximum speed limits; and, in powers of department and

4

local authorities, further providing for regulation of

5

traffic on Pennsylvania Turnpike.

6

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Sections 3362(a) and (c)(1) and 6110(a) and (a.1)

9

of Title 75 of the Pennsylvania Consolidated Statutes are

10

amended to read:

§ 3362.  Maximum speed limits.

12

(a)  General rule.--Except when a special hazard exists that

13

requires lower speed for compliance with section 3361 (relating

14

to driving vehicle at safe speed), the limits specified in this

15

section or established under this subchapter shall be maximum

16

lawful speeds and no person shall drive a vehicle at a speed in

17

excess of the following maximum limits:

18

(1)  35 miles per hour in any urban district.

(1.1)  65 miles per hour for all vehicles on freeways

where the department has posted a 65-miles-per-hour speed

2

limit.

(1.2)  25 miles per hour in a residence district if the

4

highway:

5

(i)  is not a numbered traffic route; and

6

(ii)  is functionally classified by the department as

7

a local highway.

(1.3)  70 miles per hour for all vehicles on any portion

9

of the Pennsylvania Turnpike where the Pennsylvania Turnpike

10

Commission has posted a 70-miles-per-hour speed limit in

11

accordance with section 6110(a) (relating to regulation of

12

Pennsylvania Turnpike).

13

(2)  55 miles per hour in other locations.

14

(3)  Any other maximum speed limit established under this

15

subchapter.

(c)  Penalty.--

18

(1)  Any person violating this section is guilty of a

19

summary offense and shall, upon conviction, be sentenced to

20

pay a fine of:

21

(i)  $42.50 for violating a maximum speed limit of 65

22

miles per hour or 70 miles per hour; or

23

(ii)  $35 for violating any other maximum speed

24

limit.

§ 6110.  Regulation of traffic on Pennsylvania Turnpike.

(a)  General rule.--The provisions of this title apply upon

28

any turnpike or highway under the supervision and control of the

29

Pennsylvania Turnpike Commission unless specifically modified by

30

rules and regulations promulgated by the commission which shall

become effective only upon publication in accordance with law. A

2

copy of the rules and regulations, so long as they are

3

effective, shall be posted at all entrances to the turnpike or

4

highway for the inspection of persons using the turnpike or

5

highway. This section does not authorize the establishment of a

6

maximum speed limit greater than 55 miles per hour, except that

7

[a] 65-miles-per-hour and 70-miles-per-hour maximum speed

8

[limit] limits for all vehicles may be established where the

9

commission has posted a 65-miles-per-hour or 70-miles-per-hour 

10

speed limit.

(a.1)  Posting.--No maximum speed limit established under

12

subsection (a)[(1) or (2)] shall be effective unless posted on

13

fixed or variable official traffic-control devices erected after

14

each interchange on the portion of highway on which the speed

15

limit is in effect and wherever else the commission shall

16

determine.

Section 2.  One year after the effective date of this

19

section, the Pennsylvania Turnpike Commission may conduct a

20

review of traffic accidents and related statistics in areas

21

along the turnpike where the speed limit was increased to 70

22

miles per hour in accordance with 75 Pa.C.S. § 3754. Any such

23

review and related statistics shall remain confidential and

24

protected and shall be neither discoverable nor admissible in

25

the same manner as reports prepared under 75 Pa.C.S. § 3754.

26

Section 3.  This act shall take effect in 60 days.
