AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, providing for private maintenance of State

3

highways; and making editorial changes.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Chapter 91 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subchapter heading

8

to read:

9

SUBCHAPTER A

GENERAL PROVISIONS

11

Section 2.  Section 9104 of Title 75 is amended to read:

12

§ 9104.  Standards and methodology for data collection.

13

The department shall initially determine the standards and

14

methodology for data collection and shall, [within ten days of

15

the effective date of this chapter] by June 28, 1980, publish

16

them in the Pennsylvania Bulletin as a basis for making such

17

determinations in subsequent years.

Section 3.  Chapter 91 of Title 75 is amended by adding a

§ 9107.  Existing highways.

8

The department shall have the power to solicit proposals to 

9

enter into contracts with private firms to operate and to make

10

capital improvements to existing State highways or portions 

11

thereof. A private firm entering into a contract with the 

12

department shall be responsible for the operation and 

13

maintenance of the State highway.

14

§ 9108.  Contracting for maintenance services.

15

(a)  General rule.--The department has the power to enter

16

into contracts with private firms for the maintenance of State

17

highways and for the maintenance of State highway vehicles. The

18

department may solicit proposals from private firms to perform

19

the maintenance work.

20

(b)  Cost comparison.--After receiving the proposals, the

21

department shall perform a cost comparison to determine whether

22

the maintenance work can be done by the department or another

23

State agency at less cost.

24

(c)  Pilot program.--The department shall solicit proposals

25

and enter into a contract or contracts to provide the

26

maintenance of an entire county maintenance district and a

27

minimum 50-mile section of interstate or limited access highway

28

for two years within six months of the effective date of this

29

subchapter. A department employee affected by a maintenance

30

contract shall be reassigned to another equal or superior

position.

§ 9109.  Report.

The department shall prepare an annual report on the

4

implementation of this subchapter. The report shall summarize 

5

progress on the pilot program, highway projects and the

6

feasibility of contracting for maintenance services. In

7

addition, the report shall contain recommendations for

8

additional legislation which may provide savings through 

9

contracting with private firms. Beginning January 2011 and each 

10

year thereafter, the report shall be submitted to the Governor,

11

the Transportation Committee of the Senate and the

12

Transportation Committee of the House of Representatives.

13

Section 4.  All acts and parts of acts are repealed insofar

14

as they are inconsistent with the addition of 75 Pa.C.S. Ch. 91

15

Subch. B.

16

Section 5.  This act shall take effect in 60 days.
