| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in licensing, further providing for eligibility, |
3 | minors and juniors. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1503(c)(2.1) of Title 75 of the |
7 | Pennsylvania Consolidated Statutes, added October 25, 2011 |
8 | (P.L.334, No.81), is amended to read: |
9 | § 1503. Persons ineligible for licensing; license issuance to |
10 | minors; junior driver's license. |

12 | (c) Junior driver's license.--The department may issue a |
13 | junior driver's license to a person 16 or 17 years of age under |
14 | rules and regulations adopted by the department and subject to |
15 | the provisions of this section. A junior driver's license shall |
16 | automatically become a regular driver's license when the junior |
17 | driver attains 18 years of age. |

19 | (2.1) For the first six months after issuance of the |

1 | junior driver's license, a junior driver shall not drive a |
2 | vehicle with more than one passenger under 18 years of age |
3 | who is not a member of the driver's immediate family unless |
4 | the junior driver is accompanied by a parent or legal |
5 | guardian. After the expiration of the first six months, a |
6 | junior driver shall not drive a vehicle with more than three |
7 | passengers under 18 years of age who are not members of the |
8 | driver's immediate family unless the junior driver is |
9 | accompanied by a parent or legal guardian. A junior driver |
10 | shall not drive a vehicle with more than one passenger under |
11 | 18 years of age who is not a member of the driver's immediate |
12 | family unless the junior driver is accompanied by a parent or |
13 | legal guardian if the junior driver has been involved in an |
14 | accident reportable under section 3746(a) for which the |
15 | junior driver is partially or fully responsible in the |
16 | opinion of the department or has been convicted of any |
17 | violation of this title. For purposes of this [subsection] |
18 | paragraph, a junior driver's immediate family shall include |
19 | [brothers, sisters, stepbrothers or stepsisters of the |
20 | driver, including adopted or foster children] minors under 18 |
21 | years of age residing in the same household as the junior |
22 | driver. |

24 | Section 2. This act shall take effect December 27, 2011, or |
25 | immediately, whichever is later. |
