AN ACT

  

1

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, providing for failure to report sexual

3

offenses against children.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 18 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 6321.  Failure to report sexual offenses against children.

(a)  Offense defined.--

10

(1)  A person commits the offense of failure to report

11

sexual offenses against children if the person, with

12

knowledge or reason to know that an offense under paragraph

13

(2) has been committed, fails to report the offense to law

14

enforcement officers.

15

(2)  The following are reportable under this subsection:

16

(i)  An offense under Chapter 31 Subchapter B

17

(relating to definition of offenses) if the victim is

under 18 years of age.

2

(ii)  An offense under section 6312 (relating to

3

sexual abuse of children).

4

(iii)  An offense under section 6318 (relating to

5

unlawful contact with minor) if the victim is under 18

6

years of age.

7

(iv)  An offense under section 6320 (relating to

8

sexual exploitation of children).

9

(b)  Penalty.--An offense under this section is graded the

10

same as the offense under subsection (a)(1) which is subject to

11

failure to report.

Section 2.  This act shall take effect in 60 days.
