Bill Title: A Supplement to the act of July 4, 2008 (P.L.1735, No.38A), entitled "An act to provide from the General Fund for the expenses of the Executive, Legislative and Judicial Departments of the Commonwealth, the public debt and the public schools for the fiscal year July 1, 2008, to June 30, 2009, for certain institutions and organizations, and for the payment of bills incurred and remaining unpaid at the close of the fiscal year ending June 30, 2008; to provide appropriations from the State Lottery Fund, the Energy Conservation and Assistance Fund, the Hazardous Material Response Fund, The State Stores Fund, the Milk Marketing Fund, the Home Investment Trust Fund, the Emergency Medical Services Operating Fund, the Tuition Payment Fund, the Banking Department Fund, the Firearm Records Check Fund, the Ben Franklin Technology Development Authority Fund and the Tobacco Settlement Fund to the Executive Department; to provide appropriations from the Judicial Computer System Augmentation Account to the Judicial Department for the fiscal year July 1, 2008, to June 30, 2009; to provide appropriations from the Motor License Fund for the fiscal year July 1, 2008, to June 30, 2009, for the proper operation of the several departments of the Commonwealth and the Pennsylvania State Police authorized to spend Motor License Fund moneys; to provide for the appropriation of Federal funds to the Executive Department of the Commonwealth and for the payment of bills remaining unpaid at the close of the fiscal year ending June 30, 2008; to provide for the additional appropriation of Federal and State funds from the General Fund for the Executive, Legislative and Judicial Departments of the Commonwealth for the fiscal year July 1, 2007, to June 30, 2008, and for the payment of bills incurred and remaining unpaid at the close of the fiscal year ending June 30, 2007," providing for an appropriation for the period from July 1, 2009, to July 31, 2009.

AN ACT

To the act of July 4, 2008 (P.L.1735, No.38A), entitled "An act

to provide from the General Fund for the expenses of the

Executive, Legislative and Judicial Departments of the

4

Commonwealth, the public debt and the public schools for the

5

fiscal year July 1, 2008, to June 30, 2009, for certain

6

institutions and organizations, and for the payment of bills

7

incurred and remaining unpaid at the close of the fiscal year

8

ending June 30, 2008; to provide appropriations from the

9

State Lottery Fund, the Energy Conservation and Assistance

10

Fund, the Hazardous Material Response Fund, The State Stores

11

Fund, the Milk Marketing Fund, the Home Investment Trust

12

Fund, the Emergency Medical Services Operating Fund, the

13

Tuition Payment Fund, the Banking Department Fund, the

14

Firearm Records Check Fund, the Ben Franklin Technology

the Executive Department; to provide appropriations from the

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Short title.

15

This act shall be known and may be cited as the July 2009

16

Appropriations Act.

17

Section 2.  Appropriation.

18

One-twelfth of the amount of each line item State

19

appropriation contained in the act of July 4, 2008 (P.L.1735,

20

No.38A), entitled "An act to provide from the General Fund for

21

the expenses of the Executive, Legislative and Judicial

22

Departments of the Commonwealth, the public debt and the public

23

schools for the fiscal year July 1, 2008, to June 30, 2009, for

24

certain institutions and organizations, and for the payment of

25

bills incurred and remaining unpaid at the close of the fiscal

26

year ending June 30, 2008; to provide appropriations from the

27

State Lottery Fund, the Energy Conservation and Assistance Fund,

28

the Hazardous Material Response Fund, The State Stores Fund, the

29

Milk Marketing Fund, the Home Investment Trust Fund, the

30

Emergency Medical Services Operating Fund, the Tuition Payment

31

Fund, the Banking Department Fund, the Firearm Records Check

32

Fund, the Ben Franklin Technology Development Authority Fund and

33

the Tobacco Settlement Fund to the Executive Department; to

34

provide appropriations from the Judicial Computer System

Augmentation Account to the Judicial Department for the fiscal

year July 1, 2008, to June 30, 2009; to provide appropriations

from the Motor License Fund for the fiscal year July 1, 2008, to

June 30, 2009, for the proper operation of the several

4

departments of the Commonwealth and the Pennsylvania State

5

Police authorized to spend Motor License Fund moneys; to provide

6

for the appropriation of Federal funds to the Executive

7

Department of the Commonwealth and for the payment of bills

8

remaining unpaid at the close of the fiscal year ending June 30,

9

2008; to provide for the additional appropriation of Federal and

10

State funds from the General Fund, the State Lottery Fund and

11

the Pharmaceutical Assistance Contract for the Elderly Fund for

12

the Executive, Legislative and Judicial Departments of the

13

Commonwealth for the fiscal year July 1, 2007, to June 30, 2008,

14

and for the payment of bills incurred and remaining unpaid at

15

the close of the fiscal year ending June 30, 2007," is

16

appropriated in the manner and for the individual purposes

17

stated in each line item State appropriation in the act of July

18

4, 2008 (P.L.1735, No.38A), for the fiscal period from July 1,

19

2009, to July 31, 2009.

Section 3.  Budget implementation.

21

The provisions of Articles XVII-A, XVII-B, XVII-C and XVII-D

22

of the act of April 9, 1929 (P.L.343, No.176), known as The

23

Fiscal Code, shall apply to the appropriations under section 2.

24

Section 4.  Retroactivity.

25

This act shall be retroactive to July 1, 2009.

26

Section 5.  Effective date.

27

This act shall take effect immediately.
