AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

information made available on the Internet.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 9798.1(c)(1)(vi) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended, subsection (c) is

8

amended by adding a paragraph and the section is amended by

9

adding a subsection to read:

§ 9798.1.  Information made available on the Internet.

11

(c)  Information permitted to be disclosed regarding

13

individuals.--Notwithstanding 18 Pa.C.S. Ch. 91 (relating to

14

criminal history record information), the Internet website shall

15

contain the following information on each individual:

(1)  For sexually violent predators, the following

2

information shall be posted on the Internet website:

(vi)  [a photograph] multiple frontal and profile

5

view color photographs of the offender, which shall be

6

updated not less than annually, the specific date each

7

photograph was taken and, for comparative purposes, the

8

most current and the most recent previously posted

9

frontal photographs taken of the offender;

(3)  (i)  If an offender fails to appear within 370 days

12

after his required annual residence verification or a

13

sexually violent predator fails to appear within 95 days

14

after his required quarterly residence verification, the

15

Internet website shall include:

16

(A)  A statement near or under the address

17

verification date that the offender or predator is

18

current or not current with the residence

19

verification requirements of this chapter.

20

(B)  An identification of whether the offender or

21

predator has absconded or is missing.

22

(ii)  For the purposes of this paragraph, the term

23

"address verification date" shall mean the most recent

24

required annual verification of the residence of an

25

offender under section 9796(b) (relating to verification

26

of residence) or the most recent required quarterly

27

verification of a sexually violent predator under section

28

9796(a).

(e)  Electronic mail notification option.--The Pennsylvania

State Police shall develop and implement an electronic mail

2

notification option on the Internet website which allows members

3

of the public to receive immediate electronic mail notification

4

when any registered offender moves into or out of a user-

5

selected area.

6

Section 2.  This act shall take effect in 60 days.
