| AN ACT |
| |
1 | Amending the act of January 17, 1968 (P.L.11, No.5), entitled |
2 | "An act establishing a fixed minimum wage and overtime rates |
3 | for employes, with certain exceptions; providing for minimum |
4 | rates for learners and apprentices; creating a Minimum Wage |
5 | Advisory Board and defining its powers and duties; conferring |
6 | powers and imposing duties upon the Department of Labor and |
7 | Industry; imposing duties on employers; and providing |
8 | penalties," providing for referendum on annual cost-of-living |
9 | increase in minimum wage. |
10 | The General Assembly of the Commonwealth of Pennsylvania |
11 | hereby enacts as follows: |
12 | Section 1. The act of January 17, 1968 (P.L.11, No.5), known |
13 | as The Minimum Wage Act of 1968, is amended by adding a section |
14 | to read: |
15 | Section 5.2. Referendum Authorized.--(a) A Statewide |
16 | referendum shall be held to authorize an annual cost-of-living |
17 | increase for employees who are paid the minimum wage. |
18 | (b) The Secretary of the Commonwealth shall submit the |
19 | referendum to the qualified electors of this Commonwealth at the |
20 | general election of 2010, in accordance with the procedures of |
21 | the act of June 3, 1937 (P.L.1333, No.320), known as the |

1 | "Pennsylvania Election Code." |
2 | (c) The referendum question shall be in the following form: |
3 | Shall the minimum wage paid in Pennsylvania be increased |
4 | each January 1 by applying the percentage change in the |
5 | Consumer Price Index for All Urban Consumers (CPI-U) for |
6 | Pennsylvania, New Jersey, Delaware and Maryland for the |
7 | most recent year reported sixty days prior to the date of |
8 | the wage adjustment, as reported by the United States |
9 | Department of Labor's Bureau of Labor Statistics? |
10 | (d) The Department of State shall draft a nonlegal |
11 | interpretative statement that shall accompany the referendum |
12 | question in accordance with section 201.1 of the "Pennsylvania |
13 | Election Code." |
14 | (e) The Secretary of the Commonwealth shall certify the |
15 | results of the referendum in accordance with the "Pennsylvania |
16 | Election Code." |
17 | (f) Approval of the referendum required under this section |
18 | shall be by a majority vote of the electors voting on the |
19 | question. |
20 | Section 2. This act shall take effect immediately. |
