AN ACT

Amending Title 25 (Elections) of the Pennsylvania Consolidated

2

Statutes, providing for voting by mail; imposing penalties;

3

and making related repeals.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 1105 of Title 25 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 1105.  Standardized forms.

9

(a)  General rule.--Whenever possible, the secretary shall

10

prescribe by regulation standardized voter registration or

11

[absentee ballot application] mail-in ballot application forms

12

which may be used, with prior approval by the secretary, by

13

political bodies, candidates and organized bodies of citizens in

14

compliance with both the provisions of this part and the act of 

15

June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania

16

Election Code.

17

(b)  Prior approval.--The secretary shall develop a system

18

whereby political bodies, candidates and organized bodies of

citizens may receive prior approval of standardized forms

2

developed pursuant to subsection (a).

3

Section 2.  Section 3302 of Title 25 is repealed:

4

[§ 3302.  Application for absentee ballots.

5

(a)  General rule.--Notwithstanding the provisions of Part IV

6

(relating to voter registration) or the act of June 3, 1937

7

(P.L.1333, No.320), known as the Pennsylvania Election Code, the

8

following persons may make application for an absentee ballot by

9

sending a letter or other signed document to the county board of

10

elections in the county in which the person's voting address is

11

located:

12

(1)  A registered elector who is unable to attend the

13

polling place on the day of any primary or election because

14

of illness or physical disability.

15

(2)  A registered elector who expects to be absent from

16

this Commonwealth or the municipality of residence because

17

duties, occupation or business require the elector to be

18

elsewhere the day of any primary or election.

19

(3)  A county employee who cannot vote due to duties

20

relating to the conduct of elections.

21

(4)  A person who will not attend a polling place because

22

of an observance of a religious holiday.

23

(b)  Contents of letter or document.--The letter or document

24

under subsection (a) shall provide the same information as is

25

provided on forms prescribed by the secretary.

26

(c)  Review and processing.--The letter or document shall be

27

subject to the same schedule as other applications for absentee

28

ballots and upon receipt by the county board of elections shall

29

be reviewed and processed in the same fashion as other

30

applications for absentee ballots.

(d)  Application prepared by political party.--An absentee

2

ballot application form containing the same information as that

3

contained on the form prescribed by the secretary, which was

4

prepared or distributed by a political party and signed by a

5

registered elector, shall be deemed for all purposes as valid

6

and shall be reviewed and processed by the county board of

7

elections in the same manner as applications on forms prescribed

8

by the secretary and supplied by the county board of elections.]

§ 3401.  Definitions.

15

The following words and phrases when used in this chapter

16

shall have the meanings given to them in this section unless the

17

context clearly indicates otherwise:

18

"Board."  A county board of elections.

19

"Mail-in ballot."  A ballot used by a mail-in voter in any

20

election.

21

"Mail-in voter."  A qualified and registered voter of this

22

Commonwealth who votes in any election using a mail-in ballot

23

under the provisions of this act.

24

"Qualified elector."  As defined in section 102 of the act of

25

June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania

26

Election Code.

27

"Secretary."  The Secretary of the Commonwealth.

28

§ 3402.  Procedure for user of mail-in ballot.

29

(a)  General rule.--A qualified elector may vote using a

30

mail-in ballot in any election held in this Commonwealth.

(b)  Application process.--Not less than seven days before an

2

election in which a qualified elector seeks to vote by mail, the

3

voter may apply to the board for a mail-in ballot. The

4

application shall be in writing on a form prepared by the

5

secretary, shall be signed by the applicant and shall state the

6

applicant's place of voting residence and the address to which

7

the ballot shall be sent. A voter who is a member of the armed

8

forces of the United States may use a Federal postcard

9

application form to apply for a mail-in ballot.

10

(c)  In-person application.--A qualified elector may apply in

11

person to the board for a mail-in ballot no later than 3 p.m. of

12

the day before the election.

13

(d)  Continuing application.--A qualified elector who wishes

14

to vote only by mail-in ballot in future general elections in

15

which the voter is eligible to vote, and who states that on an

16

application for a mail-in ballot, shall be furnished a mail-in

17

ballot by the board without further request on the part of the

18

elector and until the elector requests that the elector no

19

longer wishes to be sent a mail-in ballot. A qualified elector

20

may indicate on an application for a mail-in ballot that the

21

elector would like to receive a mail-in ballot for each election

22

that takes place during the remainder of the calendar year in

23

which the application is completed and submitted. A qualified

24

elector who exercises this option shall be furnished with a

25

mail-in ballot for each election that takes place during the

26

remainder of the calendar year without further request by the

27

voter. A person voting by mail-in ballot who registered by mail

28

after January 1, 2011, who did not provide personal

29

identification information when registering and is voting for

30

the first time in his or her current county of residence

following registration shall include copies of the required

2

identification information with the mail-in ballot. Failure to

3

include the information with the mail-in ballot shall result in

4

its rejection.

5

(e)  Suspension of mail-in ballots.--In the event that a

6

qualified elector who has requested a mail-in ballot for all

7

elections does not complete and return the ballot for canvassing

8

for the fourth general election following the general election

9

at which the voter last voted, the board shall send a notice to

10

that elector to ascertain whether the elector continues to

11

reside at the address from which that voter is registered to

12

vote and continues to be eligible to vote. If the notice is not

13

completed and returned by the qualified elector to the clerk

14

before the 40th day prior to the next general election, a mail-

15

in ballot shall not be sent to the voter for that election. The

16

ability of the qualified elector to receive a mail-in ballot for

17

future elections shall be suspended until the elector submits a

18

new application for a mail-in ballot that indicates that the

19

elector wishes to receive the ballot for all future general

20

elections.

21

(f)  Inactive electors.--The board shall not transmit a mail-

22

in ballot to a person who is deemed to be an inactive voter or

23

whose registration file has been deleted.

24

§ 3403.  Publication of notice.

25

(a)  Notice.--The board shall publish the following notice in

26

substantially the following form:

NOTICE TO PERSONS WANTING MAIL-IN BALLOTS

28

If you are a qualified and registered voter of this

29

Commonwealth who wants to vote by mail in the .............

30

(municipal, primary, general or other) election to be held on

.......... (date of election), complete the application form

2

below and send it to the board at the address below, or write

3

or apply in person to the board requesting that a mail-in

4

ballot be forwarded to you. The request must state your home

5

address and the address to which the ballot should be sent.

6

The request must be dated and signed.

7

If any person has assisted you to complete the mail-in

8

ballot application, the name, address and signature of the

9

assistor must be provided on the application, and you must

10

sign and date the application for it to be valid and

11

processed.

12

No mail-in ballot will be provided to an applicant who

13

submits a request by mail unless the request is received at

14

least seven days before the election and contains the

15

requested information. A voter may, however, request an

16

application in person from the board no later than 3 p.m. of

17

the day before the election.

18

A voter who wants to vote only by mail in all future

19

general elections in which the voter is eligible to vote, and

20

who states that on the application, shall, after the initial

21

request and without further action on the voter's part, be

22

provided a mail-in ballot by the county clerk until the voter

23

requests that the voter no longer wants to be sent a mail-in

24

ballot. A voter's failure to vote in the fourth general

25

election following the general election at which the voter

26

last voted may result in the suspension of that voter's

27

ability to receive a mail-in ballot for all future general

28

elections unless a new application is completed and filed

29

with the board.

30

A voter also has the option of indicating on the mail-in

ballot application that the voter would prefer to receive

2

mail-in ballots for each election that takes place during the

3

remainder of the calendar year. A voter who exercises this

4

option will be furnished with mail-in ballots for each

5

election that takes place during the remainder of this

6

calendar year, without further action on the voter's part.

7

Application forms may be obtained by applying to the

8

board either in writing or by telephone, or the application

9

form provided below may be completed and forwarded to the

10

board.

(b)  Overseas voters.--The secretary shall provide all

17

information regarding overseas Federal election voter ballots to

18

a qualified elector eligible for a mail-in ballot. The secretary

19

shall also make available valid overseas Federal election voter

20

registration and ballot applications to a qualified elector who

21

is a member of the armed forces of the United States and who is

22

a permanent resident of this Commonwealth, or who is an overseas

23

Federal election voter who wishes to register to vote or to vote

24

in any jurisdiction in this Commonwealth. The secretary shall

25

provide such public notice as may be deemed necessary to inform

26

members of the armed forces of the United States and overseas

27

Federal election voters how to obtain valid overseas Federal

28

election voter registration and ballot applications.

29

(c)  Publicity program.--The secretary shall undertake a

30

program to inform voters in this Commonwealth about their

eligibility to vote by mail under this chapter. Dissemination of

2

this information shall be effectuated by such means as the

3

secretary deems appropriate and to the extent that funds for the

4

dissemination are appropriated, including, but not limited to,

5

by means of Statewide or local electronic media, public service

6

announcements, notices on the Internet website of the Department

7

of State or any other department or agency of this Commonwealth

8

deemed appropriate by the secretary, and special mailings or

9

notices in newspapers or other publications circulating in the

10

counties or municipalities of this Commonwealth.

11

(d)  Identification.--The mail-in ballot materials shall

12

contain a notice that any person voting by mail-in ballot who

13

has registered by mail after January 1, 2011, who did not

14

provide personal identification information when registering and

15

is voting for the first time in his or her current county of

16

residence shall include copies of the required identification

17

information with the mail-in ballot, and that failure to include

18

the information shall result in the rejection of the ballot.

19

(e)  Publication.--The notice under subsection (a) shall be

20

published not less than 50 days immediately preceding any

21

election. Notices relating to any Statewide or countywide

22

election shall be published in at least two newspapers published

23

in each county. The board shall publish the same in at least one

24

newspaper published in each municipality in which the election

25

is to be held or, if no newspaper is published in the

26

municipality, in a newspaper published in the county and

27

circulating in the municipality. All notices shall be display

28

advertisements.

29

§ 3404.  Printing of mail-in ballots.

30

(a)  General rule.--A board shall print sufficient mail-in

ballots for each election. Along with the ballots the board

2

shall also furnish inner and outer envelopes and printed

3

directions for the preparation and transmitting of the mail-in

4

ballots used in the election in the county.

5

(b)  Paper type.--The mail-in ballots shall be printed on

6

paper of a different color from that used for any primary or

7

general election ballot, but in all other respects shall be as

8

nearly as possible facsimiles of the election ballot to be voted

9

at the election.

10

§ 3405.  Verification of voter's signature for issuance of mail-

11

in ballot.

12

(a)  Verification.--Upon receipt of a request for a mail-in

13

ballot, the board shall cause the signature of the applicant to

14

be compared with the signature of the person appearing on the

15

permanent registration form, or the digitalized image of the

16

voter's signature stored in the Statewide voter registration

17

system, to determine from the examination, and any other

18

available information, if the applicant is a voter qualified to

19

cast a ballot in the election, and determine in case of a

20

primary election the political party primary in which the voter

21

is entitled to vote.

22

(b)  Approval or disapproval.--If after examination the board

23

is satisfied that the applicant is entitled to a ballot, the

24

board shall mark the application "approved." If after

25

examination the board determines that the applicant is not

26

entitled to a ballot, the board shall mark the application

27

"disapproved" and shall notify the applicant, stating the reason

28

for the disapproval.

29

§ 3406.  Delivery of mail-in ballots.

30

(a)  Delivery method.--Starting on the 40th day before the

day an election is held, a board shall forward mail-in ballots

2

by first-class postage or hand delivery to each mail-in voter

3

whose request for a mail-in ballot has been approved. Mail-in

4

ballots that have been approved before the 40th day before an

5

election shall be forwarded or delivered no later than the third

6

business day following that 40th day. Hand delivery of a mail-in

7

ballot shall be made by the board or the board's designee only

8

to the voter, or the voter's authorized messenger, who must

9

appear in person. No person may serve as an authorized messenger

10

for more than ten qualified voters in an election. Ballots that

11

have not been hand delivered shall be addressed to the voter at

12

the forwarding address given in the application.

13

(b)  Timing.--

14

(1)  Whenever the board forwards a mail-in ballot by mail

15

to a mail-in voter between the 40th day and the 13th day

16

before the day of an election, the ballot shall be

17

transmitted within three business days of the receipt of the

18

application.

19

(2)  Whenever the board forwards a mail-in ballot by mail

20

to a mail-in voter between the 12th day and the seventh day

21

before the day of an election, the ballot shall be

22

transmitted within two business days of the receipt of the

23

application.

24

§ 3407.  Lists of applications and returned mail-in ballots.

25

(a)  List of applications.--Each board shall keep one list of

26

the applications for mail-in ballots received and another list

27

of the applicants whose applications were approved and sent

28

mail-in ballots. Each list shall include the name and street

29

address of each person requesting or receiving a mail-in ballot.

30

The board shall update the lists each business day, and they

shall be made available to the public and transmitted to all

2

election officials charged with the duty of administering this

3

chapter.

4

(b)  List of returned mail-in ballots.--Each board shall keep

5

a list of the name and street address of each person who returns

6

a voted mail-in ballot and the name and street address of each

7

person who delivers the ballot personally to the board. The

8

board shall update the list each business day, and it shall be

9

accessible to the public and transmitted to all elections

10

officials charged with the duty of administering this chapter.

11

The board shall keep the lists required by this section starting

12

no later than the 14th day before the day of the election and

13

continue to do so until the day of the election.

14

§ 3408.  Mail-in ballot format.

15

(a)  Conformity with other ballots and notice.--Mail-in

16

ballots to be used during any election shall conform generally

17

to the ballot to be used during the election in the voter's

18

district but the ballots shall be clearly marked "official mail-

19

in ballot." At the top of every mail-in ballot there shall be

20

printed or stamped in a prominent size the following:

IT IS AGAINST THE LAW FOR ANYONE EXCEPT YOU THE VOTER TO

23

MARK OR INSPECT THIS BALLOT.

24

However, a family member may assist you in doing so.

25

(b)  Format.--Mail-in ballots shall be printed entirely in

26

black ink. In addition to conforming generally to the ballot

27

used in the election, the mail-in ballot shall be so prepared

28

that the voter may indicate on it the voter's choice of the

29

candidates for the offices to be filled, and the public

30

questions to be voted on during the election by the voters of

the entire State, county or municipality in which the voter is a

2

resident, as known on the 48th day preceding the election.

3

Sufficient space shall be provided on the ballot for the voter

4

to write in the name of and vote for any candidate for, or the

5

voter's personal choice for, any public office to be voted for

6

during the election in the voter's election district. A list of

7

the candidates for the offices to be filled in each election

8

district in the county, whose names are known on the day on

9

which the ballot is forwarded but do not appear on the ballot,

10

with a statement of the office for which each is a candidate,

11

shall be forwarded with the mail-in ballot.

12

(c)  Candidates.--When mail-in ballots are prepared, the name

13

of any candidate who has been nominated for any office shall be

14

placed on the ballot to be used in the general election to be

15

held in the year in each election district in which he or she is

16

a candidate, whether or not the candidate has accepted

17

nomination prior to when the ballot was prepared, provided that

18

the candidate has not declined the nomination before the ballot

19

was prepared.

20

(d)  Primary election ballots.--Mail-in ballots to be used

21

during any presidential primary election or primary election for

22

the general election shall, except as otherwise provided,

23

conform to the ballot to be used during the election in the

24

voter's election district and to the form prescribed in this

25

section for mail-in ballots to be used in such general

26

elections. It shall be prepared so that the voter may indicate

27

the voter's choice of the candidates of one political party for

28

each of the officers to be voted on during the election by the

29

voters of the election district and shall be separated into

30

party ballots, which shall be printed upon one sheet when the

voting system so allows. The mail-in ballots shall be plainly

2

marked to indicate that only one party ballot is to be voted by

3

each voter and that the party ballot voted by the voter must

4

conform to the name of the political party indicated by the

5

board. If the board has determined by investigating a voter's

6

registration record that the voter is qualified to vote only in

7

the primary of a particular party, the clerk shall so note on

8

the primary ballot the party primary in which the voter is

9

entitled to vote. In the case where the board has ascertained

10

through investigating the voter's registration record that the

11

applicant is requesting a ballot to vote in the first primary

12

for which the voter is eligible after registration, the clerk

13

shall note on the primary ballot that the voter can vote in the

14

primary of any political party.

15

(e)  Electronic canvassing systems.--A county may adopt a

16

system of electronic scanning or other mechanical or electronic

17

device if the system has been approved previously by the

18

secretary to count or canvass mail-in ballots. The board in any

19

county adopting such a system may prepare and use mail-in

20

ballots that do not conform generally to the ballot to be used

21

during the election to the extent that the nonconformance is

22

necessary in the operation of the electronic or mechanical

23

canvassing system.

24

§ 3409.  Directions for preparation and transmitting of mail-in

25

ballots.

26

(a)  Directions and outer envelope.--Each board shall send,

27

with each mail-in ballot, printed directions for the preparation

28

and transmitting of the ballots as required by this chapter. The

29

directions shall be printed in such manner and form as the

30

secretary shall require, together with two envelopes of such

sizes that one will contain the other. The outer envelope shall

2

be addressed to the board of the county in which is located the

3

home address of the person to whom the mail-in ballot is sent,

4

as certified by the board. At the discretion of the board, the

5

outer envelope may be a postage-paid return envelope. On the

6

outside and front of each outer envelope, there shall be printed

7

or stamped the following:

to the board of elections and seal that envelope.

bringing it to the board of elections, MAKE CERTAIN THAT

PERSON COMPLETES THE "BEARER PORTION" ON THE ENVELOPE

28

ADDRESSED TO THE BOARD OF ELECTIONS BEFORE THE BALLOT IS

29

TAKEN FROM YOU. NO PERSON WHO IS A CANDIDATE IN THE ELECTION

30

FOR WHICH THE VOTER REQUESTS THIS BALLOT IS PERMITTED TO

SERVE AS A BEARER.

(b)  Changes to instructions.--The secretary is authorized to

3

make such changes to the instructions for mail-in ballot

4

materials as the secretary deems necessary or as is mandated by

5

Federal or State law.

6

(c)  Inner envelope.--The inner envelope shall be so designed

7

that it can be sealed after the mail-in ballot has been placed

8

in the inner envelope and the flap of the inner envelope shall

9

be of such length and size as to leave sufficient margin, after

10

being sealed, for the printing on the flap of the certificate

11

described in section 3410 (relating to certificate of mail-in

12

voter). The flap shall be so arranged that, after the inner

13

envelope has been sealed, the certificate can be contained, with

14

the inner envelope, in the outer envelope, and that the margin

15

containing the certificate can be detached without unsealing the

16

inner envelope. On the outside of each envelope in which a mail-

17

in ballot is sent to a mail-in voter by the board, there shall

18

be printed or stamped the words "official mail-in ballot." In

19

addition, there shall be printed or stamped the following:

OPEN, MARK, INSPECT OR SEAL THIS BALLOT.

However, a family member may assist you in doing so.

A PERSON MAY BE FINED AND IMPRISONED AND MAY ALSO LOSE

27

THE RIGHT TO VOTE UNTIL RESTORED BY LAW if that person

28

attempts to vote fraudulently by mail-in ballot, prevents the

29

voting of a legal voter, certifies falsely any information,

30

interferes with a person's secrecy of voting, tampers with

ballots or election documents or helps another person to do

2

so.

§ 3410.  Certificate of mail-in voter.

4

On the margin of the flap on the inner envelopes to be sent

5

to mail-in voters there shall be printed a certificate in the

6

following form:

I, ........ (print your name clearly), whose home address

9

is ...................... (street address or R.D. Number)

(municipality), DO HEREBY CERTIFY, subject to the penalties for

11

fraudulent voting, that I am the person who applied for the

12

enclosed ballot. I MARKED AND SEALED THIS BALLOT AND CERTIFICATE

13

IN SECRET. However, a family member may assist me in doing so.

§ 3411.  Certification by county clerk.

28

Each board shall, from time to time and prior to each

29

election, certify in writing under oath to the secretary the

30

names and addresses of the persons to whom mail-in ballots to be

voted during the election have been delivered or forwarded under

2

this chapter.

§ 3412.  Marking of mail-in voter's record.

4

(a)  Marking of record.--The board shall mark the mail-in

5

voter's record in the Statewide voter registration system and

6

duplicate voting record appearing on the signature copy

7

registers. Whenever a mail-in ballot has been forwarded to a

voter during the time when the signature copy registers are in

9

the custody of other election officials pursuant to current law,

10

or are in transit to or from those officials, the board shall,

11

prior to the opening of the polls on election day, forward to

12

each polling place a list of all the voters to whom ballots have

13

been sent but whose duplicate voting record has not been marked

14

in the manner prescribed. The lists may be prepared in the same

15

manner as a challenge sheet and may be included together with

16

other causes for challenge. Any person whose name appears on any

17

list or notice furnished by the board to the effect that the

18

voter has received a mail-in ballot, but who wishes nevertheless

19

to vote at the polls on the day of an election, shall be

20

permitted to vote by provisional ballot after completing the

21

affirmation statement attached to the envelope provided with the

22

provisional ballot.

23

(b)  Notice to judge of polling place.--Whenever a mail-in

24

ballot has been delivered to a voter less than seven days before

25

an election and up to 3 p.m. of the day before the election, and

26

the signature copy registers are in the custody of other

27

election officials, or in transit to or from those officials,

28

the board shall prepare a master list of those mail-in ballots

29

and shall notify the judge of the polling place to mark the

30

voter's record accordingly.

§ 3413.  Marking of mail-in ballot by voter, delivery to board.

2

(a)  Marking of mail-in ballot.--A mail-in voter shall be

3

entitled to mark a mail-in ballot forwarded to the voter for

4

voting during any election by indicating the voter's choice of

5

candidates for the offices named, and as to public questions, if

6

any, stated on the ballot, in accordance with current law. In

7

the case of ballots to be voted for a primary election, the

8

voter's choice shall be limited to the candidates of the voter's

9

political party or to any person whose name is written on the

10

ballot by the voter. When so marked, the ballot shall be placed

11

in the inner envelope, which shall then be sealed, and the voter

12

shall then fill in the form of certificate attached to the inner

13

envelope, at the end of which the voter shall sign and print the

14

voter's name. The inner envelope with the certificate shall then

15

be placed in the outer envelope, which shall then be sealed.

16

(b)  Tampering.--No mail-in voter may permit a person, except

17

as provided by this chapter, to unseal, mark or inspect the

18

voter's ballot, interfere with the secrecy of the voter's vote,

19

complete or sign the certificate or seal the inner or outer

20

envelope.

21

(c)  Assistance.--A mail-in voter may receive assistance from

22

a family member in performing any of the actions provided for in

23

this section. The family member or other person providing

24

assistance shall certify that the family member assisted the

25

voter and will maintain the secrecy of the vote by both printing

26

and signing the family member's name in the space provided on

27

the certificate. In no event may a candidate for election

28

provide assistance, nor may any person, at the time of providing

29

assistance, campaign or electioneer on behalf of any candidate.

(d)  Delivery to board.--

(1)  The sealed outer envelope with the inner envelope

2

and the ballot enclosed shall either be mailed to the board

3

to which it is addressed or delivered personally by the voter

4

or a bearer designated by the voter to the board. To be

5

counted, the ballot must be received by the board or its

6

designee before the time designated for the closing of the

7

polls on the day of an election.

8

(2)  Whenever a person delivers a ballot to the board,

9

that person shall sign a record maintained by the county of

10

all mail-in ballots personally delivered to it.

11

(3)  No person may serve as an authorized messenger for

12

more than ten qualified voters in an election. No person who

13

is a candidate in the election for which the voter requests a

14

mail-in ballot may serve as an authorized messenger. The

15

messenger, by signing the certification, certifies that he or

16

she received a mail-in ballot directly from the voter and is

17

authorized to deliver the ballot to the board on behalf of

18

the voter.

19

§ 3414.  Actions by county board of elections relative to mail-

20

in ballot.

21

(a)  Actions upon receipt of ballot.--The board shall,

22

promptly after receiving each mail-in ballot, remove the inner

23

envelope containing the ballot from the outer envelope and shall

24

compare the signature and the information contained on the flap

25

of the inner envelope with the signature and information

26

contained in the respective requests for mail-in ballots. In

27

addition, as to mail-in ballots issued less than seven days

28

prior to an election, the board shall also check to establish

29

that the mail-in voter did not vote in person. The board shall

30

reject a ballot if it is not satisfied, pursuant to a comparison

with the Statewide voter registration system, that the voter is

2

legally entitled to vote and that the ballot conforms with the

3

requirements of this chapter.

4

(b)  Primary elections.--In the case of a mail-in ballot to

5

be voted during a primary election, the ballot shall be rejected

6

if the mail-in voter has indicated in the certificate the

7

voter's intention to vote in a primary election of any political

8

party and if it shall appear from the record that the voter is

9

not entitled to vote in a primary election of the political

10

party which has been so indicated.

11

(c)  Seal.--A mail-in ballot which is received by the board

12

shall be rejected if both the inner and outer envelopes are

13

unsealed or if either envelope has a seal that has been tampered

14

with.

15

§ 3415.  Counting of mail-in ballots.

16

The board shall count all valid mail-in ballots received by

17

the board prior to the time designated by current law for the

18

closing of the polls for each election.

19

§ 3416.  Mail-in ballot deemed valid.

20

No mail-in ballot may be rejected or declared invalid because

21

it does not contain all of the names of the candidates or all of

22

the public questions to be voted for in the election district in

23

the election in which it is to be counted. A mail-in ballot

24

shall be counted in determining the result of the election as to

25

any office or public question, if the designation of the office

26

and the name of the candidate for election to the office or the

27

answer to the public question is indicated on the ballot to

28

demonstrate the voter's choice.

29

§ 3417.  Mail-in voters not permitted to vote in person.

30

(a)  General rule.--A person who has applied for a mail-in

ballot and has had the mail-in ballot either delivered in person

2

or forwarded by mail and voted and returned the voted ballot to

3

the board shall not be permitted to vote in person at the

4

polling place in the voter's election district on the day of the

5

election.

6

(b)  Exceptions.--The following persons shall be permitted to

7

vote in person by provisional ballot at the polling place in the

8

voter's election district on the day of election:

9

(1)  A person who has applied for a mail-in ballot and

10

not received either the ballot or an explanation for not

11

receiving the ballot from the board.

12

(2)  A person who has applied for and received a mail-in

13

ballot and has not transmitted it to the board or given it to

14

a messenger for delivery to the board before the time for the

15

opening of the polls on the day of an election.

16

§ 3418.  Rejection of ballot mailed in by voter subsequently

17

deceased.

18

Whenever the board receives evidence that a mail-in voter who

19

has marked and forwarded a mail-in ballot has died before the

20

opening of the polls on the day of the election, the board shall

21

reject the ballot.

22

§ 3419.  Opening of mail-in ballots.

23

(a)  Opening of ballots.--On the day of an election a board

24

shall open the inner envelopes that contain the mail-in ballots

25

with the votes cast for the election. The inner envelopes

26

containing the ballots that the board has rejected shall not be

27

so opened, but shall be retained. The board shall then proceed

28

to canvass the votes cast on the mail-in ballots. No ballot may

29

be counted in any primary election if the ballot of the

30

political party marked for voting differs from the designation

of the political party for which the ballot is intended to be

2

voted as marked on the envelope by the board.

3

(b)  Certification.--Immediately after the canvass is

4

completed, the respective boards shall certify the result of the

5

canvass to the secretary or other appropriate officer, as the

6

case may be, showing the result of the canvass by municipality

7

and ward. The votes canvassed shall be counted in determining

8

the result of the election.

9

(c)  Primary election.--The board shall, immediately after

10

the canvass is completed for a primary election, certify the

11

results of the votes cast for members of the county committees

12

to the respective municipal clerks, and those votes shall be

13

counted in determining the result of the election.

14

§ 3420.  Marking in voting records to show mail-in ballots

15

delivered.

16

As soon as practicable after each election, the board shall

17

mark in the Statewide voter registration system and all

18

duplicate voting records to show that mail-in ballots were

19

delivered or forwarded to the respective registered voters. For

20

each mail-in ballot that has been voted, received and counted,

21

the board shall also, by reference to the certificates removed

22

from the inner envelopes of the ballots, place the word "voted"

23

in the space provided in the Statewide voter registration system

24

and duplicate voting record for recording the ballot number of

25

the voter's ballot in the election. In the case of a primary

26

election, the board shall also note in the proper space of the

27

Statewide voter registration system or other record of voting

28

form the first three letters of the name of the political party

29

primary in which the ballot was voted. The record contained in

30

the Statewide voter registration system and of voting forms in

the original permanent registration binders shall be conformed

2

to the foregoing entries in the duplicate forms.

3

§ 3421.  Records of mail-in ballots.

4

The board shall keep, for two years, the requests and

5

applications for mail-in ballots, voted mail-in ballots and

6

certificates that have been detached or separated by them from

7

the inner envelopes. Inner envelopes together with their

8

certificates and the contents of those envelopes not opened

9

shall also be retained for the same period by the board. The

10

District Attorney shall have the authority to impound all mail-

11

in ballots whenever the District Attorney shall deem it

12

necessary.

13

§ 3422.  No election held invalid due to mail-in ballots.

14

No election may be held to be invalid due to any irregularity

15

or failure in the preparation or forwarding of mail-in ballots.

16

§ 3423.  Ballot required to be sealed before delivery.

17

No person may take a mail-in ballot from a voter or other

18

person having custody of it for the purpose of delivering it to

19

the board or to a postal box or post office, nor shall any voter

20

permit any person to do so, unless the ballot is sealed in the

21

outer envelope and the person who transports or delivers it

22

first signs and prints his or her name on the outer envelope.

23

§ 3424.  Information for voters using mail-in ballot.

24

The secretary shall post on the VotesPA Internet website

25

established and maintained by the Department of State that any

26

individual who casts a mail-in ballot may ascertain:

27

(1)  Whether an application for a mail-in ballot has been

28

approved and if not, the reason for its rejection.

29

(2)  Whether the mail-in ballot was accepted for counting

30

and, if the ballot was not counted, the reason for the

rejection of the ballot.

2

The system shall at all times preserve the confidentiality of

3

each person who has requested an application to vote by mail-in

4

ballot or who has voted by mail-in ballot, and shall ensure that

5

no person, other than the individual who requested or cast the

6

ballot, may discover whether or not that individual's

7

application or ballot was accepted, unless so informed by the

8

voter.

9

§ 3425.  Election by mail, duties of board.

10

The board shall:

11

(1)  Publish, in advance of the election and pursuant to

12

rules and regulations promulgated by the secretary, official

13

notice that the election shall be conducted by mail together

14

with such other information regarding the conduct of the

15

election as shall be deemed necessary by the secretary.

16

(2)  Mail a ballot, including an outer envelope and an

17

inner envelope substantially similar to the envelopes

18

provided for mail-in ballots, not sooner than the 20th day

19

prior to the day of the election nor later than the 14th day

20

prior to the day of the election, to each person registered

21

to vote in the municipality during that election.

22

(3)  Designate the board's office as the place to obtain

23

a replacement ballot.

24

(4)  Designate places within the county or municipality

25

that shall be available for the deposit of voted ballots for

26

the election.

27

(5)  Make a provisional ballot available at the office of

28

the board so that each person who has been a resident of the

29

county or municipality in which the person seeks to register

30

and vote at least 21 days prior to the day of the election

and has moved to a location within the municipality after

2

that 21st day prior to the day of the election may vote.

3

(6)  Distribute to each registered voter in the

4

municipality with each ballot a copy of the voter information

5

notice provided for and supplemented by the secretary as

6

deemed appropriate for use in municipalities conducting

7

elections by mail, and instruction about the completion of

8

the ballot as deemed necessary by the secretary.

9

(7)  Make certain that all qualified voters in the

10

municipality requesting a mail-in ballot between the 40th day

11

and the 21st day prior to the day of an election receive the

12

ballot after the 20th day prior to the day of an election and

13

voters requesting a ballot on or before the seventh day prior

14

to the date of the election shall receive a ballot authorized

15

under this section.

16

(8)  Establish, in consultation with the secretary, the

17

time by which all ballots must be received by the board on

18

the day of an election to be considered valid and counted.

19

§ 3426.  Mail-in ballot fraud.

20

(a)  Offense.--A person who commits any of the following acts

21

is guilty of a misdemeanor of the third degree:

22

(1)  Fraudulently votes or attempts to vote by mail or

23

enables or attempts to enable another person not entitled to

24

vote or to vote by mail to vote fraudulently by mail.

25

(2)  Prevents or attempts to prevent by fraud the voting

26

of a person legally entitled to vote by mail.

27

(b)  Penalty.--A person convicted under subsection (a) shall

28

be subject, in addition to such other penalties as are

29

authorized by law, to disenfranchisement for a period of time

30

determined by the court.

Section 4.  Repeals are as follows:

2

(1)  The General Assembly declares that the repeal under

3

paragraph (2) is necessary to effectuate the purposes of this

4

act.

5

(2)  Article XIII of the act of June 3, 1937 (P.L.1333,

6

No.320), known as the Pennsylvania Election Code, and any

7

other provision of that act to the extent that it is

8

inconsistent with this act is repealed.

9

(3)  All other acts and parts of acts are repealed

10

insofar as they are inconsistent with this act.

11

Section 5.  This act shall take effect in 60 days.
