AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for information in

3

central repository or automated systems.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 9106(d) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 9106.  Information in central repository or automated systems.

(d)  Secondary dissemination [prohibited].--A criminal

11

justice agency which possesses information protected by this

12

section, but which is not the source of the information, [shall

13

not] may disseminate or disclose the information to another

14

criminal justice agency. [but shall refer the requesting agency

15

to the agency which was the source of the information. This

16

prohibition shall not apply if the agency receiving the

information is investigating or prosecuting a criminal incident

2

in conjunction with the agency possessing the information.]

3

Agencies receiving information protected by this section assume

4

the same level of responsibility for the security of such

5

information as the agency which was the source of the

6

information.

Section 2.  This act shall take effect in 60 days.
