AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for motorcycle safety education

3

program.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 7911 of Title 75 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 7911.  Motorcycle safety education program.

9

(a)  General rule.--The department shall establish a

10

motorcycle safety education program throughout this

11

Commonwealth. It shall approve and conduct an annual review of

12

course material for authorized schools. It shall certify all

13

instructors and shall include a uniform curriculum for the

14

course of instruction and training requirements for instructors.

The department shall be responsible for certifying schools to

2

conduct approved motorcycle safety courses and shall adopt such

3

necessary rules and regulations to govern the administration of

4

motorcycle education within this Commonwealth.

(b)  Exemption from liability.--The owner of land who

6

authorizes the owner's his property to be used for the purposes

of an approved motorcycle safety education program as provided

8

in subsection (a) shall not be held civilly liable for any

9

injury or death to persons or damage to property that may occur

10

during the course of instruction or training, except for willful

11

or malicious failure to warn against a dangerous condition, use,

12

structure or activity.

Section 2.  This act shall take effect in 60 days.
