| AN ACT |
| |
1 | Providing for ethics in government; prohibiting certain uses of |
2 | public resources; and providing for penalties. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Public |
7 | Resource Protection Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Campaign." An effort organized in support of or opposition |
13 | to the nomination, election or re-election of an individual to |
14 | an elective office. |
15 | "Campaign activity." Any of the following activities: |
16 | (1) Preparing, circulating, copying, notarizing, filing |
17 | or challenging petitions, certificates or papers for the |

1 | nomination of a candidate. |
2 | (2) Planning, organizing or conducting a meeting of a |
3 | political body, political committee, political organization |
4 | or political party. |
5 | (3) Preparing or completing a questionnaire on behalf of |
6 | an individual who has filed petitions, papers or a |
7 | certificate for nomination as a candidate. |
8 | (4) Directing or managing a campaign or providing the |
9 | following services on behalf of a candidate or an elected |
10 | official: |
11 | (i) Soliciting or collecting a campaign |
12 | contribution. |
13 | (ii) Planning, organizing or conducting a campaign |
14 | rally, campaign fundraising event or other campaign event |
15 | that promotes a campaign or a candidate. |
16 | (iii) Preparing or filing a campaign finance report. |
17 | (iv) Conducting background research on a candidate |
18 | or an elected official to be used or intended to be used |
19 | to influence the outcome of an election. |
20 | (v) Preparing, distributing or mailing campaign |
21 | literature, campaign signs or other materials related to |
22 | a political campaign. |
23 | (vi) Soliciting an individual's vote for a candidate |
24 | in an election. |
25 | (vii) Working at a polling place. |
26 | (5) Conducting or participating in campaign polling. |
27 | (6) Participating as an observer in a canvass or re- |
28 | canvass of election results conducted under the act of June |
29 | 3, 1937 (P.L.1333, No.320), known as the Pennsylvania |
30 | Election Code. |

1 | (7) Challenging or participating in the challenge of the |
2 | outcome of an election. |
3 | "Campaign polling." The organized preparing, compiling, |
4 | collection or gathering of information, including focus groups |
5 | and surveys, reflecting public opinion as to any elected |
6 | official, group of elected officials, candidate, group of |
7 | candidates, political body, political organization or political |
8 | party, that is intended to be used for the purpose of supporting |
9 | or opposing the nomination, election or re-election of an |
10 | individual to elective office. |
11 | "Candidate." An individual seeking nomination, election or |
12 | reelection to an elective office. |
13 | "De minimus." An economic consequence which has an |
14 | insignificant effect. |
15 | "Elected official." An individual elected by the public to |
16 | serve a term in an elective office. The term shall include an |
17 | individual appointed to fill an unexpired term in an elective |
18 | office. |
19 | "Election." A general, special, municipal or primary |
20 | election. The term shall include any election at which a |
21 | candidate for elective office in a Federal governmental body is |
22 | on the ballot. |
23 | "Elective office." A position in a governmental body or a |
24 | Federal governmental body to which an individual is required |
25 | under the Constitution of Pennsylvania, the Constitution of the |
26 | United States or by law to be elected by the public. |
27 | "Federal governmental body." The executive, legislative or |
28 | judicial branch of the United States. |
29 | "Governmental body." A department, authority, commission, |
30 | committee, council, board, bureau, division, service, office, |

1 | administration, legislative body or other establishment in the |
2 | executive, legislative or judicial branch of the Commonwealth or |
3 | a political subdivision of the Commonwealth. |
4 | "Nomination." The term shall have the meaning given to it |
5 | under the act of June 3, 1937 (P.L.1333, No.320), known as the |
6 | Pennsylvania Election Code. |
7 | "Own time." A public employee's time that is distinct from |
8 | work time. The term shall include time spent on leave. |
9 | "Political body." An organization, not recognized under the |
10 | act of June 3, 1937 (P.L.1333, No.320), known as the |
11 | Pennsylvania Election Code, as a political party, that has filed |
12 | papers for the nomination of a candidate in the manner provided |
13 | by law. |
14 | "Political committee." The term shall have the meaning given |
15 | to it in the act of June 3, 1937 (P.L.1333, No.320), known as |
16 | the Pennsylvania Election Code. |
17 | "Political organization." An organization, not recognized |
18 | under the act of June 3, 1937 (P.L.1333, No.320), known as the |
19 | Pennsylvania Election Code, as a political party or political |
20 | body, whose primary activities are conducted to influence the |
21 | outcome of an election of a candidate. |
22 | "Political party." The term shall have the same meaning as |
23 | the term "party" is given in 25 Pa.C.S. § 1102 (relating to |
24 | definitions). The term shall include a political party's |
25 | national, State and county committees. |
26 | "Public employee." An individual employed by a governmental |
27 | body. An individual elected to a governmental body shall not be |
28 | deemed to be an employee of that governmental body. |
29 | "Public funds." All money collected, received or held by, |
30 | for or on account of a governmental body. |

1 | "Public resources." Facilities, equipment, property and |
2 | supplies purchased or owned by a governmental body and labor |
3 | provided by a public employee during work time. |
4 | "Work time." Compensated time spent in the performance of |
5 | job duties. |
6 | Section 3. Campaign use of public resources prohibited. |
7 | (a) Offense defined.--It shall be an offense to knowingly |
8 | expend public funds or knowingly use public resources on a |
9 | campaign activity. |
10 | (b) Penalty.-- |
11 | (1) Except as provided under paragraph (2), an |
12 | individual found to have committed an offense under |
13 | subsection (a) shall be guilty of a misdemeanor of the second |
14 | degree. |
15 | (2) If the aggregate value of the public funds expended |
16 | or the public resources used for the campaign activity |
17 | performed in violation of subsection (a) exceeds $2,000, an |
18 | individual found to have committed an offense under |
19 | subsection (a) shall be guilty of a felony of the third |
20 | degree. |
21 | (3) In addition to the punishment imposed under |
22 | paragraph (1) or (2), an individual found to have committed |
23 | the offense under subsection (a) shall pay restitution to the |
24 | governmental body in an amount equal to three times the cost |
25 | or three times the market value, whichever is greater, of the |
26 | campaign activity for which the public funds or public |
27 | resources were used. |
28 | (4) The offense defined under subsection (a) shall be |
29 | considered a crime related to public office or public |
30 | employment for purposes of the act of July 8, 1978 (P.L.752, |

1 | No.140), known as the Public Employee Pension Forfeiture Act. |
2 | (c) Construction.--Nothing in this section shall be |
3 | construed to prohibit the following: |
4 | (1) A public employee from engaging in a campaign |
5 | activity on the public employee's own time. |
6 | (2) De minimis campaign activities that are unavoidable |
7 | by an elected official or a public employee in the course of |
8 | their official duties. This includes the following |
9 | activities: |
10 | (i) An elected official or a public employee may, in |
11 | responding to inquiries from the public, need to address |
12 | incidental questions that relate to a candidate's |
13 | campaign. |
14 | (ii) An elected official or a public employee may |
15 | provide scheduling assistance and information to campaign |
16 | staff to ensure that no conflict occurs among the elected |
17 | official's campaign schedule, official schedule and |
18 | personal schedule. |
19 | (iii) An elected official or a public employee may |
20 | engage in political conversation in the natural course of |
21 | personal communication. |
22 | (d) False reports.--An individual who makes a fictitious |
23 | report or gives false information relating to an offense under |
24 | this section commits a misdemeanor of the second degree. |
25 | Section 4. Effective date. |
26 | This act shall take effect immediately. |
