| AN ACT |
| |
1 | Amending Title 61 (Penal and Correctional Institutions) of the |
2 | Pennsylvania Consolidated Statutes, amending the heading of |
3 | Title 61; adding definitions; and providing for prerelease |
4 | testing. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. The heading of Title 61 of the Pennsylvania |
8 | Consolidated Statutes is amended and the title is amended by |
9 | adding parts to read: |

10 | This act shall be known and may be cited as the Prisons and |
11 | Parole Code. |
12 | § 102. Definitions. |
13 | The following words and phrases when used in this title shall |
14 | have the meanings given to them in this section unless the |
15 | context clearly indicates otherwise: |
16 | "Board." The Pennsylvania Board of Probation and Parole. |
17 | "Department." The Department of Corrections of the |
18 | Commonwealth. |
19 | "Inmate." A person committed to a term of imprisonment or |
20 | otherwise confined under the custody of the Commonwealth or a |
21 | county in a correctional institution in accordance with law. |

7 | (a) Requirement.--The department shall, prior to releasing |
8 | an inmate in any manner, test the inmate for disease. |
9 | (b) Results.--Results of the tests conducted under |
10 | subsection (a) shall be provided to the inmate prior to the |
11 | inmate's release. |
12 | (c) Definitions.--For the purposes of this section, the |
13 | following words and phrases shall have the meaning given to them |
14 | in this subsection unless the context clearly indicates |
15 | otherwise: |
16 | "Disease." Any of the following: |
17 | (1) A staphylococcus aureus infection. |
18 | (2) A bloodborne disease. |
19 | (3) A communicable disease. |
20 | (4) Acquired immune deficiency syndrome (AIDS). |
21 | (5) Human immunodeficiency virus (HIV). |
22 | (6) A venereal or sexually transmitted disease. |
23 | (7) Hepatitis. |
24 | (8) Tuberculosis. |
25 | (9) Any other disease as determined by the department by |
26 | regulation. |

30 | Section 2. This act shall take effect in 60 days. |
