                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Transfers from Oregon Department of Administrative Services to
Oregon Criminal Justice Commission duty to issue state
corrections population forecasts and state juvenile offender
population forecasts. Requires commission to rely on conclusions
and recommendations of Correction Population Forecasting Advisory
Committee and Juvenile Correction Population Forecasting Advisory
Committee in making state corrections population forecasts and
state juvenile offender population forecasts, respectively.
  Applies to state corrections population forecasts and state
juvenile offender population forecasts issued on or after October
1, 2011.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to correctional population forecasts; creating new
  provisions; amending ORS 184.351; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 184.351 is amended to read:
  184.351. (1) The   { - Oregon Department of Administrative
Services - }   { + Oregon Criminal Justice Commission + } shall
issue { + :
  (a) + } State corrections population forecasts including  { - ,
but not limited to, - }  expected populations of prisons
 { - and jails - }  and community corrections caseloads  { - , to
be used by: - }  { + ; and
  (b) State juvenile offender population forecasts including
expected populations of youth correction facilities as defined in
ORS 420.005 and youth offender community placement caseloads.
  (2)(a) For purposes of the state corrections population
forecasts issued under subsection (1) of this section, the Oregon
Criminal Justice Commission shall rely on conclusions and
recommendations provided to the commission by the Correction
Population Forecasting Advisory Committee created by Executive
Order 95-06.
  (b) For purposes of the state juvenile offender population
forecasts issued under subsection (1) of this section, the
commission shall rely on conclusions and recommendations provided
to the commission by the Juvenile Correction Population
Forecasting Advisory Committee created by Executive Order 98-06.
  (3)(a) State corrections population forecasts issued by the
Oregon Criminal Justice Commission may be used by: + }
    { - (a) - }   { + (A) + } The Department of Corrections in
preparing budget requests;
    { - (b) - }   { + (B) + } The   { - Oregon Criminal
Justice - }  commission in considering amendments to sentencing
guidelines; and
    { - (c) - }   { + (C) + } Any other state agency concerned
with the effect of offender populations or policy developments on
budgeting.
   { +  (b) State juvenile offender population forecasts issued
by the commission may be used by:
  (A) The Oregon Youth Authority in preparing budget requests;
and
  (B) Any other state agency concerned with the effect of
juvenile offender populations or policy developments on
budgeting. + }

Commission + } shall issue state corrections population forecasts

April 1 and October 1 of each year.
  SECTION 2.  { + The amendments to ORS 184.351 by section 1 of
this 2011 Act apply to state corrections population forecasts and
state juvenile offender population forecasts issued on or after
October 1, 2011. + }
  SECTION 3.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
