                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Requires Oregon University System, Oregon Health and Science
University or community college district to grant share in
acquired intellectual property to commodity commission in
proportion to percentage of research dollars provided by
commodity commission. Requires commodity commission approval of
any disposition of intellectual property if commodity commission
owns more than five percent of property.

                        A BILL FOR AN ACT
Relating to acquisitions of intellectual property rights in
  commodities.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) For any intellectual property that is
acquired by the State Board of Higher Education with monetary
assistance from a commodity commission established under ORS
576.051 to 576.455, the board must provide to the commodity
commission a share of ownership of the intellectual property that
is proportionate to the share of research dollars, calculated as
a percentage, provided by the commodity commission. In
calculating the percentages of ownership of the intellectual
property belonging to the Oregon University System and the
commodity commission, the board may include only the actual costs
of its research in determining its own contribution to creation
of the intellectual property.
  (2) If a commodity commission's share of ownership under
subsection (1) of this section is five percent or greater, the
board may not dispose of the intellectual property by sale,
lease, license or other action without the approval of the
commodity commission by a majority of the members of the
commodity commission. + }
