SUMMARY

Establishes pilot project that provides alternative method for
distributing funding to school districts for special education
and related services for students in kindergarten through grade
three.
Requires Department of Education to submit report to
legislative committees on education.
Sunsets July 1, 2013.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to funding for special education and related services;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2011 Act is added to and made
a part of ORS 327.006 to 327.133. + }
SECTION 2. { + (1)(a) The Department of Education shall
establish a pilot project that provides an alternative method for
distributing funding to school districts for special education
and related services for students in kindergarten through grade
three.
(b) School districts participating in the pilot project shall
use the funding received as provided by this section to implement
the response to intervention process for identifying and
assisting students who may be eligible for special education and
related services.
(c) School districts participating in the pilot project are
encouraged to use the funding received as provided by this
section for early intervention reading strategies and similar
strategies that may result in fewer students requiring special
education and related services in later grades as a result of the
strategies.
(2) The department shall select no fewer than 10 school
districts to participate in the pilot project established by this
section. The department may establish an application process for
the purpose of the selection of the school districts.
(3) Notwithstanding ORS 327.013 (1)(c)(A)(i) and in lieu of
funding that a school district would receive under ORS 327.013
(1)(c)(A)(i) for students in kindergarten through grade three, a
school district participating in the pilot project established by
this section shall receive an additional amount that is equal to
11 percent of the district's ADM for students in kindergarten
through grade three. The amount calculated under this subsection
for students in kindergarten shall take into account the
requirements prescribed by ORS 327.006 (1).
(4) School districts participating in the pilot project shall
provide information to the department that is sufficient for the
department to submit the report required by subsection (5) of
this section.
(5) The department shall submit a report to the legislative
committees related to education no later than May 1, 2013. The
report required by this subsection shall:
(a) Summarize the efforts of the school districts participating
in the pilot project established by this section; and
(b) Provide information about whether fewer students require
special education and related services or are incorrectly
determined to be eligible for special education and related
services as the result of the intervention strategies funded as
provided by this section. + }
SECTION 3. { + Adjustments to the distributions from the State
School Fund that are made to school districts participating in
the pilot project described in section 2 of this 2011 Act apply
only to the 2011-2013 distributions. + }
SECTION 4. { + Sections 2 and 3 of this 2011 Act are repealed
on July 1, 2013. + }
SECTION 5. { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
