SUMMARY

Appropriates moneys from General Fund to Oregon Department of
Post-Secondary Education for certain biennial expenses.
Limits biennial expenditures of department from lottery moneys
allocated from Administrative Services Economic Development Fund
and Education Stability Fund.
Limits biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by department.
Limits biennial expenditures of department from federal funds.
Limits biennial expenditures of department from timber tax
severance funds and Oregon Health and Science University Bond
Fund.
Authorizes specified nonlimited expenditures.
Declares emergency, effective July 1, 2013.
A BILL FOR AN ACT
Relating to the financial administration of the Oregon Department
of Post-Secondary Education; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:

of Post-Secondary Education, for the biennium beginning July 1,

expenditures, the amount of $9,779,594 is established for the
biennium beginning July 1, 2013, as the maximum limit for payment
of expenses from lottery moneys allocated to the Oregon
Department of Post-Secondary Education from the Administrative
Services Economic Development Fund for debt service on lottery
bonds sold for the benefit of Oregon community colleges. + }
SECTION 3. { + Notwithstanding any other law limiting
expenditures, the amount of $28,488,687 is established for the
biennium beginning July 1, 2013, as the maximum limit for payment
of expenses from lottery moneys allocated to the Oregon
Department of Post-Secondary Education from the Administrative
Services Economic Development Fund for debt service on lottery
bonds sold for the benefit of Oregon public universities. + }
SECTION 4. { + Notwithstanding any other law limiting
expenditures, the amount of $320,178 is established for the
biennium beginning July 1, 2013, as the maximum limit for payment
of expenses from lottery moneys allocated to the Oregon
Department of Post-Secondary Education from the Education
Stability Fund for Oregon Opportunity Grants. + }

SECTION 7. { + Notwithstanding any other law limiting
expenditures, the amount of $25,308 is established for the
biennium beginning July 1, 2013, as the maximum limit for payment
of expenses by the Oregon Department of Post-Secondary Education
from moneys received from the Western Oregon Timber Severance Tax
Fund and the Eastern Oregon Timber Severance Tax Fund for the
Community College Support Fund. + }
SECTION 8. { + Notwithstanding any other law limiting
expenditures, the amount of $31,639,826 is established for the
biennium beginning July 1, 2013, as the maximum limit for payment
of expenses by the Oregon Department of Post-Secondary Education
from the Oregon Health and Science University Bond Fund for the
following purposes:
(1) Paying the principal of, and the interest and premium on,
outstanding general obligation bonds;
(2) Funding the general obligation bond reserves; and
(3) Paying amounts due in connection with any instrument
authorized by section 18 (4)(c), chapter 921, Oregon Laws
2001. + }
SECTION 9. { + For the biennium beginning July 1, 2013,
expenditures by the Oregon Department of Post-Secondary Education
for payments to individuals, organizations or units of government
from federal National Emergency Grant funds are not limited. + }
SECTION 10. { + For the biennium beginning July 1, 2013,
expenditures by the Oregon Department of Post-Secondary Education
for federal funds debt service on Build America Bonds sold for
the benefit of Oregon public universities are not limited. + }
SECTION 11. { + For the biennium beginning July 1, 2013,
expenditures by the Oregon Department of Post-Secondary Education
of moneys from the Tuition Protection Fund are not limited. + }
SECTION 12. { + This 2013 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2013 Act takes effect
July 1, 2013. + }
