It is an editor's brief statement of the essential features of the measure as introduced. Directs Department of Transportation to apply for grants to study benefits and costs of increasing allowable registration weight to greater than 105,500 pounds. Creates Vehicle Registration Weight Study Fund. Continuously appropriates moneys in fund to Department of Transportation for purpose of study. Sunsets study and fund on January 2, 2014. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to a study of vehicle registration weight; appropriating money; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) The Department of Transportation shall undertake a study to examine the following: (a) The benefits and costs of increasing the allowable registration weight for motor vehicles to greater than 105,500 pounds; (b) The capability of the highway infrastructure to handle an increase in the registration weight limits and, if the infrastructure is not currently capable, whether the benefits of the increased weight limits will exceed the costs of increased maintenance, reconstruction or additional highway infrastructure for motor vehicles with a registration weight greater than 105,500 pounds, and by how much; (c) The optimum user fee that should be paid to maintain the highway infrastructure if the allowable registration weight for motor vehicles increases to greater than 105,500 pounds; and (d) The user fee and gross vehicle weight combination that best increases the likelihood of coordination and competition between commercial motor vehicles with a registration weight greater than 105,500 pounds, marine transport and rail for intrastate and interstate movement of goods. (2) The Director of Transportation shall appoint an advisory committee to assist the department in conducting the study required by this section. Members of an advisory committee are volunteers and serve without compensation or payment for actual or necessary expenses. (3) The department shall apply for public or private grants and may receive and administer funds, including federal funds and grants, to pay for the costs of conducting the study. (4) The director shall appoint members to the advisory committee no later than 30 days after adjournment sine die of the regular session of the 2011 Legislative Assembly. (5) The department shall report the results of the study to the to the interim legislative committees related to transportation no later than October 1, 2012, or at such times at the committees may designate. (6) As used in this section, 'registration weight' has the meaning given that term in ORS 801.420. + } SECTION 2. { + (1) The Vehicle Registration Weight Study Fund is established in the State Treasury, separate and distinct from the General Fund. All moneys in the Vehicle Registration Weight Study Fund are continuously appropriated to the Department of Transportation for the purpose of carrying out the provisions of section 1 of this 2011 Act. (2) All moneys received under this section 1 of this 2011 Act shall be deposited into the Vehicle Registration Weight Study Fund to be expended by the department for the purpose of carrying out the provisions of section 1 of this 2011 Act. + } SECTION 3. { + (1) Sections 1 and 2 of this 2011 Act are repealed on January 2, 2014. (2) Any moneys remaining in the Vehicle Registration Weight Study Fund on January 2, 2014, that are unexpended, unobligated and not subject to any conditions shall revert to the General Fund. + } SECTION 4. { + This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect on its passage. + } ----------
