                             AN ACT

Relating to women's health.

Be It Enacted by the People of the State of Oregon:

  SECTION 1.  { + (1) A facility, as defined in 42 U.S.C. 263b,
must provide written notice, in the form prescribed by the Oregon
Health Authority under subsection (2) of this section, to a
patient on whom the facility has performed a mammogram if the
mammogram shows the patient has dense breast tissue.
  (2) The authority shall prescribe by rule the form and content
of the notice provided under subsection (1) of this section. The
notice must include but is not limited to all of the following:
  (a) Information about breast density, based on the Breast
Imaging Reporting and Data System established by the American
College of Radiology;
  (b) An explanation that dense breast tissue can make it harder
to find cancer on a mammogram and that dense breast tissue may
also be associated with an increased risk of breast cancer;
  (c) That the patient may benefit from supplementary screening
or diagnostic testing including a breast ultrasound; and
  (d) That the patient should contact the patient's health care
provider to find out whether the health care provider recommends
additional testing.
  (3) The authority shall adopt by rule a definition of 'dense
breast tissue' and shall amend the definition whenever necessary
to ensure that the definition is consistent with current medical
evidence. + }
