                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Increases number of Court of Appeals judges from 10 to 13.
Provides that new positions become operative July 1, 2012.
  Appropriates moneys from General Fund to pay costs of new
judges.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to Court of Appeals; creating new provisions; amending
  ORS 2.540; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 2.540 is amended to read:
  2.540. (1) The Court of Appeals shall consist of   { - 10 - }
 { +  13 + } judges.
  (2) A judge of the Court of Appeals shall be an elector of the
county of the residence of the judge and be admitted to the
practice of law in this state.
  (3) Each judge of the Court of Appeals shall hold office for a
term of six years and until a successor is elected and qualified.
  SECTION 2.  { + (1) The amendments to ORS 2.540 by section 1 of
this 2011 Act become operative July 1, 2012.
  (2) As soon as possible after the amendments to ORS 2.540 by
section 1 of this 2011 Act become operative, the Governor shall
appoint persons to serve on the Court of Appeals in the positions
created by the amendments to ORS 2.540 by section 1 of this 2011
Act until successors are elected and qualified. + }
  SECTION 3.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Judicial Department,
for the biennium beginning July 1, 2011, out of the General Fund,
the amount of $_______, which may be expended to pay the salary
and benefits for the new judicial positions created by the
amendments to ORS 2.540 by section 1 of this 2011 Act, the salary
and benefits for the support staff required for those positions
and the cost of office space, equipment and furnishings necessary
for those positions. + }
  SECTION 4.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
