                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Creates crime of unlawfully transferring large capacity
magazine. Punishes by maximum of one year's imprisonment, $6,250
fine, or both.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to large capacity magazines; creating new provisions;
  amending ORS 161.005; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) A person commits the crime of unlawfully
transferring a large capacity magazine if the person knowingly
sells, or otherwise transfers for consideration, a large capacity
magazine.
  (2) This section does not apply to the sale or transfer for
consideration of a large capacity magazine to:
  (a) A law enforcement unit of the federal government or a law
enforcement unit as defined in ORS 181.610; or
  (b) The active or reserve military forces of this state or of
the United States.
  (3) Unlawfully transferring a large capacity magazine is a
Class A misdemeanor.
  (4) As used in this section, 'large capacity magazine ' means
an ammunition feeding device with the capacity to accept more
than 10 rounds of ammunition, but does not include:
  (a) A feeding device that has been permanently altered so that
it cannot accommodate more than 10 rounds of ammunition.
  (b) A tubular magazine that is contained in a lever action
firearm.
  (c) A 0.22 caliber tube ammunition feeding device. + }
