                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires that total amount of General Fund appropriations,
special purpose appropriations to Emergency Board, lottery fund
allocations, appropriations from Oregon Rainy Day Fund and
appropriations from Education Stability Fund made for public
education purposes in biennium not be less than 50 percent of
total amount of General Fund appropriations, lottery fund
allocations, appropriations from Oregon Rainy Day Fund and
appropriations from Education Stability Fund contained in
legislatively adopted budget and legislatively approved budget
for biennium.
  First applies to biennium beginning July 1, 2011.
  Sets July 1, 2017, sunset date.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to state finance; and declaring an emergency.
  The Legislative Assembly finds that:
  (1) The Oregon Constitution has required since its adoption
that the 'Legislative Assembly shall provide by law for the
establishment of a uniform, and general system of Common schools.
'
  (2) With the creation of the Oregon Education Investment Board,
there is a need to provide financial stability in order to:
  (a) Meet the educational goals described in ORS 329.015;
  (b) Create and nurture an educated populace; and
  (c) Provide a strong educational foundation to support the
achievement of the state's educational mission described in ORS
351.009.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Each biennium, the total amount of General
Fund appropriations, special purpose appropriations, lottery fund
allocations, appropriations from the Oregon Rainy Day Fund
established under ORS 293.144 and appropriations, allocations or
transfers from the Education Stability Fund established by ORS
348.696 made for public education purposes may not be less than
50 percent of the total amount of General Fund appropriations,
lottery fund allocations, appropriations from the Oregon Rainy
Day Fund established under ORS 293.144 and appropriations,
allocations or transfers from the Education Stability Fund
established by ORS 348.696 contained in the legislatively adopted
budget and the legislatively approved budget for the biennium.
  (2) For purposes of this section, a General Fund appropriation,
special purpose appropriation, lottery fund allocation or
appropriation from the Oregon Rainy Day Fund established under
ORS 293.144 is made for public education purposes if it is made
to or appropriated for allocation to:
  (a) The Department of Education;
  (b) The Department of Community Colleges and Workforce
Development;
  (c) The Oregon University System;
  (d) The State Board of Higher Education;
  (e) The Oregon Health and Science University;
  (f) The Oregon Student Access Commission;
  (g) The Teacher Standards and Practices Commission; or
  (h) Any other state agency for the purpose of benefiting this
state's system of kindergarten through grade 12 public education
or higher education in this state.
  (3) As used in this section:
  (a) 'Legislatively adopted budget' means the budget enacted by
the Legislative Assembly during an odd-numbered year regular
session.
  (b) 'Legislatively approved budget' means the legislatively
adopted budget as modified by the Emergency Board meeting in an
interim period or by the Legislative Assembly meeting in special
session or in an even-numbered year regular session.
  (c) 'Lottery fund allocations' means allocations of lottery
funds from the Administrative Services Economic Development Fund,
other than allocations made for the purpose of debt service.
  (d) 'Special purpose appropriation' means an appropriation to
the Emergency Board, out of the General Fund, for allocation for
public education purposes. + }
  SECTION 2.  { + Section 1 of this 2012 Act first applies to the
biennium beginning July 1, 2011. + }
  SECTION 3.  { + Section 1 of this 2012 Act is repealed July 1,
2017. + }
  SECTION 4.  { + This 2012 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2012 Act takes effect on its
passage. + }
