                             SUMMARY

The following summary is not prepared by the sponsors of the

  Requires criminal records check for volunteers and employees
who staff State Emergency Operations Center or emergency
operating facility of city or county.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to emergency management; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2013 Act is added to and made
a part of ORS chapter 401. + }
  SECTION 2.  { + (1) The Office of Emergency Management shall
cause the Department of State Police to conduct a criminal
records check under ORS 181.534 of volunteers and paid personnel
who staff a State Emergency Operations Center, as described in
ORS 401.092, from which the Governor and the office can perform
duties under this chapter.
  (2) The emergency management agency of a city or county shall
cause the sheriff of the county to conduct a criminal records
check of volunteers and paid personnel who staff an emergency
operating facility, as described in ORS 401.305, from which
elected or appointed officials can direct emergency or disaster
response activities. The criminal records check under this
subsection must include a check for a criminal record in the
State of Oregon. In addition, a national criminal records check
is required under this subsection if:
  (a) The person has resided in another state within five years
before the date that the criminal records check is performed;
  (b) The person has disclosed the existence of a criminal
conviction; or
  (c) A criminal records check in the State of Oregon discloses
the existence of a criminal record in another jurisdiction.
  (3) This section does not require a unique criminal records
check for volunteers or paid personnel serving in positions for
which their public employers have already required a criminal
records check. + }
  SECTION 3.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
