Conditionally suspends prohibition against retail customer dispensing of motor vehicle fuel if state of emergency requiring mandatory evacuation is declared. A BILL FOR AN ACT Relating to the dispensing of fuels during a state of emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + Section 2 of this 2013 Act is added to and made a part of ORS 480.315 to 480.385. + } SECTION 2. { + (1) As used in this section, 'declared state of emergency' means: (a) A major disaster, as defined in 42 U.S.C. 5122 (2), declared by the President of the United States; (b) A state of emergency declared by the Governor under ORS 401.165; or (c) A state of emergency declared by a city or county under ORS 401.309. (2) If a declared state of emergency includes an order for mandatory evacuation, during the term of the state of emergency the prohibition under ORS 480.330 does not apply within the designated area of the state of emergency if: (a) The filling station, service station, garage or other dispensary is closed or is unattended; (b) The pumps or other devices for dispensing liquid fuel are on and ready to be activated; and (c) The filling station, service station, garage or other dispensary has automated equipment on the pump or other device to allow the receipt of payment for fuel by credit card, money or other means. (3) Subsection (2) of this section does not authorize the installation or use of any dispensing device prohibited under ORS 480.340. + } ----------
