SUMMARY

Provides that person may not operate motor vehicle with gross
vehicle weight rating greater than 200 pounds or specified
all-terrain vehicles in beds or banks of certain waterways.
Specifies exceptions. Makes operation of motor vehicle with gross
vehicle weight rating greater than 200 pounds or specified
all-terrain vehicles in beds or banks of certain waterways
punishable by maximum fine of $2,000.
A BILL FOR AN ACT
Relating to waterways.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section:
(a) 'Gross vehicle weight rating' has the meaning given that
term in ORS 801.298.
(b) 'Motor vehicle' has the meaning given that term in ORS
801.360.
(2) A person may not operate a motor vehicle with a gross
vehicle weight rating that is greater than 200 pounds, a Class I
all-terrain vehicle as defined in ORS 801.190, a Class II
all-terrain vehicle as defined in ORS 801.193, a Class III
all-terrain vehicle as defined in ORS 801.194 (1) or a Class IV
all-terrain vehicle as defined in ORS 801.194 (2) in the beds or
banks of any waterway in the Common School Forest Lands or the
Elliott State Forest Lands designated and set aside as described
in ORS 530.450 to 530.520.
(3) This section does not apply to vehicles specified in
subsection (2) of this section:
(a) Owned by this state, a local government as defined in ORS
174.116 or the federal government.
(b) Engaged in rescue or emergency activities.
(c) That cross the beds or banks of any waterway in forest
lands specified in subsection (2) of this section from a road
surface on one side of the waterway to a road surface immediately
opposite on the other side of the waterway.
(d) Engaged in other activities specified in rules adopted by
the Department of State Lands, after consultation with the State
Forester.
(4) This section does not apply to boats as defined in ORS
830.005.
(5) Violation of this section is a Class A violation. + }

committed on or after the effective date of this 2013 Act. + }
