                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Directs specified state agencies to file with Senate and House
interim committees on general government affairs annual report
describing amount of federal funds received by each agency in
preceding fiscal year and containing plan to operate agency if
amount of federal funds received by agency in current fiscal year
is reduced by 10 percent or 20 percent.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to state financial administration; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Federal funds' means 'federal financial assistance, ' as
defined in 31 U.S.C. 7501, that is reported in a single audit.
  (b) 'Legislatively adopted budget' means the budget enacted by
the Legislative Assembly during an odd-numbered year regular
session.
  (c) 'Legislatively approved budget' means the legislatively
adopted budget as modified by the Emergency Board meeting in an
interim period or by the Legislative Assembly meeting in special
session or in an even-numbered year regular session.
  (d) 'Single audit' has the meaning given that term in 31 U.S.C.
7501.
  (e) 'State agency' means the Department of Environmental
Quality, the Department of Transportation, the State Department
of Agriculture and the State Parks and Recreation Department.
  (2) Not later than October 31 of each year, a state agency
shall prepare a report that:
  (a) Describes the aggregate amount of federal funds received by
the state agency for the immediately preceding fiscal year ending
June 30;
  (b) Describes the aggregate amount of federal funds authorized
by the Legislative Assembly to be expended by the state agency
for the immediately preceding fiscal year ending June 30;
  (c) Describes the percentage of the total legislatively
approved budget for the state agency for the immediately
preceding fiscal year that constitutes federal funds received by
the state agency; and
  (d) Contains a plan for operating the state agency in the
current fiscal year if there is a reduction of:
  (A) 10 percent or more in the federal funds that the state
agency receives; and
  (B) 20 percent or more in the federal funds that the state
agency receives.
  (3) Not later than November 1 of each year, a state agency
shall file the report with the interim committees of the Senate
and House that have responsibility for general government
affairs.
  (4) Not later than November 30 of each year, the interim
committees of the Senate and House that have responsibility for
general government affairs jointly shall prepare a report that:
  (a) Compiles and summarizes the reports received by the
committees under subsection (3) of this section; and
  (b) Compares the aggregate amount of federal funds received by
each state agency for the immediately preceding fiscal year
ending June 30 to the aggregate amount of federal funds
authorized by the Legislative Assembly to be expended by the
state agency for the fiscal year.
  (5) Not later than November 30 of each year, the interim
committees of the Senate and House that have responsibility for
general government affairs:
  (a) May hold hearings on the report described in subsection (4)
of this section;
  (b) May vote to approve the report; and
  (c) Shall file the report with the Joint Interim Committee on
Ways and Means, including any comments provided by the members of
the committees.
  (6) Upon receipt of the report filed under subsection (5) of
this section, the cochairs of the Joint Interim Committee on Ways
and Means shall place the report on the agenda of the next
meeting of the Joint Interim Committee on Ways and Means or of
the Emergency Board, whichever occurs first.
  (7) When considering the report filed under subsection (5) of
this section, the Joint Interim Committee on Ways and Means or
the Emergency Board may:
  (a) Recommend that the Legislative Assembly modify
appropriations or expenditure limitations for a state agency;
  (b) Take no action; or
  (c) Take another action approved by the committee or board. + }
  SECTION 2.  { + This 2012 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2012 Act takes effect on its
passage. + }
