                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Requires financial institutions that disperse government
benefits through debit cards to provide certain information about
fees imposed for use of debit cards.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to debit cards; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Financial institution' has the meaning given that term in
ORS 706.008.
  (b) 'State agency' means any state department, division, bureau
or other agency or body headed by an elected or appointed state
officer or member of a board or commission.
  (2) A financial institution that contracts with a state agency
to disperse government benefits to individuals through the
issuance of debit cards shall:
  (a) Disclose in a clear and conspicuous manner all fees
associated with the use of the debit cards to:
  (A) Each individual issued a debit card.
  (B) Each state agency with whom the financial institution has a
contract.
  (b) Report to the state agency, by the first day of January,
April, July and October of each calendar year, the total amount
collected from any fee imposed by the financial institution for
the use of the debit cards.
  (3) A state agency may adopt rules for the administration of
this section. + }
  SECTION 2.  { + This 2012 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2012 Act takes effect on its
passage. + }
