It is an editor's brief statement of the essential features of the measure as introduced. Directs state agencies and local governments with functions related to issuance of registrations, licenses, certifications or permits necessary to conduct business in Oregon to provide nonmonetary assistance to qualified persons. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to nonmonetary assistance for Oregon businesses; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) As used in this section: (a) 'Local government' means a municipality or a county or any other political subdivision of this state. (b) 'Person' means any individual, association of individuals, joint venture, partnership, limited liability company, business trust, unincorporated business organization or corporation. (c) 'State agency' means every officer, board, commission, department, institution, branch or agency of the state government, as defined in ORS 174.111. (2) All state agencies and local governments that have functions related to the issuance of registrations, licenses, certifications or permits necessary for the conduct of business in Oregon are directed to provide nonmonetary assistance to qualified persons upon request. (3)(a) A person is a qualified person for purposes of subsection (2) of this section if the person: (A) Is or will be conducting business in Oregon or is relocating a business within or to Oregon; and (B) Commits in writing, whether by execution of a contract or otherwise, to hire at least ___ new employees who are residents of Oregon. (b) Priority for the provision of nonmonetary assistance under subsection (2) of this section shall be given to qualified persons that commit to hire ___ new employees who are Oregon residents and who have been recipients of unemployment insurance benefits under an unemployment insurance law of this or another state in the year preceding the qualified person's request for nonmonetary assistance. (4) Nonmonetary assistance to be provided under subsection (2) of this section includes, but is not limited to: (a) Expediting and prioritizing the review of applications of qualified persons for registrations, licenses, certifications and permits necessary for the conduct of business in Oregon and, if the applications are denied, expediting and prioritizing the appeal processes for reconsideration of denied applications; (b) Expediting and prioritizing the provision of information and technical assistance to a qualified person, including but not limited to information about state agency and local government rules, regulations, ordinances and policies that apply to the conduct of the qualified person's business; and (c) Coordination with other state agencies or local governments when qualified persons are subject to multi-jurisdictional, multi-governmental requirements related to registrations, licenses, certifications or permits necessary for the conduct of business in Oregon, so as to reduce duplicative and inconsistent efforts and results. (5) A state agency or local government providing nonmonetary assistance under subsection (2) of this section may not provide assistance that compromises public or environmental health or safety, that diminishes standards required for the conduct of business in Oregon or that contravenes federal, state or local laws. + } SECTION 2. { + This 2012 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2012 Act takes effect on its passage. + } ----------
