                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Directs Department of Corrections to seek to negotiate with
Multnomah County to operate Wapato Jail as minimum security
correctional institution for inmates who are ill, elderly or
physically incapacitated. Authorizes department to enter into
negotiations with private entities to administer and operate
Wapato Jail. Requires department to provide corrections officers
assigned to Wapato Jail. Directs department to adopt rules that
modify recreational and security requirements for inmates in
Wapato Jail. Directs department, in consultation with Department
of Human Services, to adopt rules that establish responsibility
for health care needs of inmates in Wapato Jail.

                        A BILL FOR AN ACT
Relating to a minimum security correctional institution.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Department of Corrections shall seek to
negotiate a contract or agreement with Multnomah County pursuant
to which the department may operate the Wapato Jail as a minimum
security institution for the confinement and detention of inmates
who require minimum security due to illness, age or physical
incapacitation.
  (2)(a) The Department of Corrections may enter into a contract
or agreement with a private entity pursuant to which the Wapato
Jail is administered and operated as described in subsection (1)
of this section by the private entity.
  (b) Notwithstanding paragraph (a) of this subsection, the
corrections officers assigned to the Wapato Jail shall be
provided by the Department of Corrections.
  (c) A contract or agreement entered into pursuant to this
subsection may provide for the transfer of inmates from
Department of Corrections institutions and local correctional
facilities at a negotiated per-day rate.
  (3) The Department of Corrections shall adopt rules:
  (a) That appropriately modify the recreational and security
requirements with respect to inmates confined to the Wapato Jail
pursuant to this section; and
  (b) In consultation with the Department of Human Services, that
establish responsibility for the health care needs of the
inmates. + }
