                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Repeals prohibition against selling or offering for sale
gasoline unless it contains 10 percent ethanol by volume.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to the sale of gasoline; creating new provisions;
  amending ORS 646.912; repealing ORS 646.913; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + ORS 646.913 is repealed. + }
  SECTION 2. ORS 646.912 is amended to read:
  646.912.   { - (1) - }  The State Department of Agriculture
shall study and monitor ethanol fuel production, use and sales in
this state.
    { - (2) When capacity of ethanol production facilities in
Oregon reaches a level of at least 40 million gallons, the
department shall notify all retail dealers, nonretail dealers and
wholesale dealers in this state, in a notice that meets the
requirements of subsection (3) of this section. - }
    { - (3) The notice under subsection (2) of this section shall
inform retail dealers, nonretail dealers and wholesale dealers
that: - }
    { - (a) The capacity of ethanol production facilities in
Oregon has reached the levels described in subsection (2) of this
section; and - }
    { - (b) Three months after the date of the notice, a retail
dealer, nonretail dealer or wholesale dealer may sell or offer
for sale only gasoline described in ORS 646.913. - }
  SECTION 3.  { + The amendments to ORS 646.912 by section 2 of
this 2011 Act and the repeal of ORS 646.913 by section 1 of this
2011 Act apply to gasoline that is sold or offered for sale on or
after the effective date of this 2011 Act. + }
  SECTION 4.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
