Creates exemption from state preemption for local laws designed
to prevent or control presence of pesticides in potable water.
A BILL FOR AN ACT
Relating to local laws regulating pesticides.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2011 Act is added to and made
a part of ORS chapter 634. + }
SECTION 2. { + This chapter does not limit the authority of a
city, town, county or other political subdivision of this state
to adopt or enforce a local ordinance, rule or regulation for the
purpose of preventing or controlling the presence of pesticides
in surface and ground water used by the city, town, county or
political subdivision as a source of potable water. + }
