                     CHAPTER ................

                             AN ACT

Relating to vesting in the pension program of the Oregon Public
  Service Retirement Plan; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

  SECTION 1.  { + Section 2 of this 2013 Act is added to and made
a part of ORS chapter 238A. + }
  SECTION 2.  { + Notwithstanding ORS 238A.115, a deceased member
of the system shall be considered vested for all purposes under
the pension program if:
  (1) The employer of the member certifies to the Public
Employees Retirement Board that the member was killed in the line
of duty on or after July 1, 2011, and before December 31, 2011;
  (2) At the time of death the member was a police officer who
was an active member of the system;
  (3) At the time of death the member had not otherwise vested in
the pension program under ORS 238A.115;
  (4) At the time of death, the member had completed at least 600
hours of service in each of three calendar years; and
  (5) An application for benefits under ORS 238A.230 is made to
the board within 60 days after the effective date of this 2013

  SECTION 3.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
