                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires public notice and hearing before governing body of
municipality may activate urban renewal agency. Requires
ordinance activating urban renewal agency to include
determinations and findings that particularize nature of blighted
areas in municipality.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to urban renewal; amending ORS 457.035; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 457.035 is amended to read:
  457.035. (1) In each municipality, as defined in ORS 457.010,
there   { - hereby - }  is created a public body corporate and
politic to be known as the 'urban renewal agency' of the
municipality.   { +
  (2)(a)  + }  { - However, the - }   { + An + } urban renewal
agency   { - shall - }   { + may + } not exercise its powers
 { - until or - }  unless the governing body of the municipality,
by nonemergency ordinance  { - , - }  { + :
  (A) + } Declares { + , after public notice and hearing and
consideration of public testimony, + } that blighted areas exist
in the municipality and that there is need for an urban renewal
agency to function in the municipality { + ; + } and  { +
  (B) + } Elects to have the powers of an urban renewal agency
exercised in any of the three ways provided in ORS 457.045.
   { +  (b) An ordinance adopted pursuant to paragraph (a) of
this subsection must include determinations and findings that
particularize the nature of the blighted areas in the
municipality. + }

activation under subsection   { - (1) - }   { + (2) + } of this

its powers within the same area of operation given a housing
authority of the municipality under ORS 456.060.

preservation of the public peace, health and safety, an emergency
