                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Provides that evidence relating to informed consent is
admissible in certain medical liability actions.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to informed consent; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2013 Act is added to and made
a part of ORS 40.010 to 40.585. + }
  SECTION 2.  { + In a civil action based on negligence in the
provision of health care or unauthorized rendering of health
care, the following evidence is admissible:
  (1) Documents evidencing that the patient provided informed
consent to the health care.
  (2) Information provided to the patient in the process of
obtaining the patient's informed consent to the health care. + }
  SECTION 3.  { + Section 2 of this 2013 Act applies only to
civil actions commenced on and after the effective date of this
2013 Act. + }
  SECTION 4.  { + This 2013 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2013 Act takes effect on its
passage. + }
