Requires financial institution that has contract with state agency to disburse government benefit to individual by means of debit card to disclose fees for using debit card or in connection with debit card to individual and state agency. Becomes operative 91 days after effective date of Act. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to debit cards used to disburse government benefits; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) As used in this section: (a) 'Financial institution' has the meaning given that term in ORS 706.008. (b) 'State agency' means any state department, division, bureau or other agency or body headed by an elected or appointed state officer or member of a board or commission. (2) A financial institution that contracts with a state agency to disburse a government benefit to an individual by means of a debit card shall: (a) Disclose in a clear and conspicuous manner all fees the individual or the state agency must pay to use the debit card or in connection with the debit card to the individual that receives the debit card and to any state agency with which the financial institution has a contract to disburse government benefits by means of a debit card. (b) Report to the state agency by the first day of January, April, July and October of each calendar year the total amount the financial institution or an affiliate or agent of the financial institution collected from fees for using or in connection with the debit card. (3) A state agency may adopt rules to implement this section. + } SECTION 2. { + Section 1 of this 2013 Act applies to a contract that a state agency first advertises or otherwise solicits or, if the state agency does not advertise or solicit the contract, to a contract the state agency enters into on or after the effective date of this 2013 Act. + } SECTION 3. { + (1) Section 1 of this 2013 Act becomes operative 91 days after the effective date of this 2013 Act. (2) A state agency may adopt rules or take other actions that are necessary to enable the state agency to exercise, on and after the operative date specified in subsection (1) of this section, all of the duties, functions and powers that section 1 of this 2013 Act confers on the state agency. + } SECTION 4. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
